CONTRACT PRACTICE QUESTION FOR PART II

Please answer the following question, you are required to use legal principles/concepts to
answer this question.

In which of the following scenarios do you think gives rise to the intention to create legal
relations/obligations? For each situation explain how you arrived at your conclusion or
answer.

(i) A widow tells her adult son that he can stay at her house temporarily so
long as he does his share of domestic chores. Consider whether the
parties have entered into be a legally binding contract under which
accommodation is supplied in return for housework. Give reasons for
your answer. (3 marks)

(ii) Jenny, a student, offers to pay her brother Jim if he will help her with an
assignment, Jim has carried out his part of the agreement, but Jenny will
not pay up. (2 marks)

(iii) Mary and her friend Bridget regularly play poker together along with a
group of 12 other people. When they started doing so, they both signed a
piece of paper to the effect that if either of them ever won more than
$100, the money would be shared equally. Mary has now won $70,000
and is refusing to pay any proportion of it to Bridget. (3 marks)

(iv) Dave, a taxi driver, agrees to take Brian to the airport. Brian will pay the
full fare. (2 marks)

(v) Dave now says that he would rather go to watch a soccer match and will
not therefore be taking Brian (2 marks)
