Objective Resolution;

1949
Introduction;
The objective resolution was
presented by Prime Minister
Liquat Ali Khan on March 7
1949 in the constituent
assembly of Pakistan, and
the constituent assembly
adapted it on March 12
1949. This resolution was a
type of skeleton for the
future Constitution of
Pakistan, and under article
2(A) of the 1973 constitution
the entire resolution was
added in the Constitution.
Following are some of the
features of objective
resolution.

Features Of Objective
Resolution;
!. Sovereignty; The ist
part of the preamble of
the 1973 constitution
says that sovereignty
belongs to Allah alone.
M. Exercise Of Authority;
The objective Resolution
says that the authority
will be exercised by
people of Pakistan with
in the limits prescribed
by Allah.
N. Principles As
Articulated By Islam;
The objective Resolution
also provides principles
as given by Islam. It
Further says that
following principles
must be observed;
● Principle of democracy

of Islam.
● Principle of freedom as

given by Islam.
● Principle of tolerance as
given by Islam.
● Principle of Equality as

given by Islam.
● Principle of social justice

as given by Islam.
S. Protection Of
Minority Rights;
Objective Resolution
ensures the protection
of Minorities. It says that
adequate provisions
shall be made for
minorities to practice
their religion freely. It
further says that
minority can develop
their culture in Pakistan.
T. Territories; Objective
Resolution also provides
the territories of
Pakistan. The following
territories include in
Pakistan;
● Punjab.
● Balochistan.
● Sindh.

● Khyber Pakhtunkhwa.

W. Fundamental Rights;
Objective resolution of
1949 guarantees
fundamental rights.
Some guaranteed
fundamental rights are
following;
● Equality before law.

● Equality Of opportunity

before law.
● Social, Economic and

political justice.
● Freedom of worship,

thought, speech.
● Protection against

arrest.
X. Independence Of
Judiciary; The
Objective Resolution
1949 also provides that
the independence of
judiciary shall be
secured fully. Difficult
procedure has been
provided for the
removal of judges.
Judiciary in Pakistan
also has the power of
judicial review.

Government;
Objective Resolution
provides the federal
form of government
with autonomous units.

Crticial Analysis;
Objective Resolution Despite
being an important
document for the future
constitution had some loop
holes in it. Lets discuss
these loopholes.
Ignored Religions Other
Than Islam;
Objective Resolution is a
religious Resolution and in a
state, different religious
people are found so there is
no need to pass a religious
resolution. Despite of this it
needed to give a clear
message that all religions
are of equal importance in
Pakistan. By giving priority
to Islam the objective
Resolution created a sort of
clash in the country between
minority and majority
because Muslims were in
majority in Pakistan and they
were given more priority as
compare to the people of
other religions.

Criticism On The
Provisions Sovereignty
Belongs To Allah;
Bhupendra Kumar Datta
from east Pakistan criticise
the opening provision of
Objective Resolution that
sovereignty belongs to Allah,
he argued that relations
between the state and the
citizen are the matter of
politics while relation
between the Man and God
comes with in the sphere of
religion. He further says that
Politics is based on reason
while religion is based on
faith. He continued his point
and argued that this
provision may also be
misused by the politician by
arguing that I am the leader
send by God. Therefore
Kumar Datta said that this
provision must be omitted.
Criticism On Provision of
Principle As Articulated
By Islam;
Bhupendra Kumar Datta
proposed that in the
paragraph ‘wherein the
principles of democracy,
freedom, equality, tolerance
and social justice, as
enunciated by Islam shall be
fully observedʼ, the words ‘as
enunciated by Islamʼ should
be omitted. He explained
that this clause has
condemned minorities ‘for
ever to an inferior status and
prevented.
Prem Hari Barma, a
member of the PNC from
East Pakistan, also
supported the above
amendment by arguing that
it would ‘cover a much wider
range of the principles of
democracy, freedom,
equality, tolerance and social
justice. But with the
retention of these words, the
paragraph would cover only
those principles of
democracy, freedom,
tolerance, equality and
social justice which have
been enunciated by Islam
with the result that many of
the universally accepted
principles of democracy,
freedom, equality, tolerance
and social justice would be
left outʼ.
He proposed that if those
words were retained, then
after the words ‘enunciated
by Islamʼ, the words ‘and
other religionsʼ be inserted.
Objective Resolution
Contradicts The Vision Of
Jinnah;
Chandra Chattopadyaya, the
leader of the PNC, referring
to the Quaid-i-Azamʼs
declaration made in the
Assembly on August 11,
1947, said that it was a clear
indication that Pakistan
would be based on ‘eternal
principles of equality and
democracyʼ. Quaid - E-
Azam the founder of
Pakistan wanted a secular
state while the objective
Resolution contradicts the
vision of Jinnah.
