    Tutorial Week Four

    Last week Tommy and Timmy decided to have a drink at Starbucks, while having a
    drink they met Ms. Goons who was sitting at the next table. Timmy wanted to
    befriend her so he ordered a drink for her and started talking to her. Ms. Goons got
    very irritated and told him that she could did not want any free drinks and started to
    leave the place. Timmy got angry and pushed her to a corner and held her wrist
    tightly until Mr. Johnson, who was sitting at the next table freed Ms. Goons.

    i) Discuss Timmy`s criminal liability.

    ii) Discuss Tommy`s criminal liability if Tommy took her back to his house and
    locked her up and had sexual intercourse with Ms. Goons by stating
    that he would kill her brother if she refused and she eventually agreed.

    iv) Identify a possible defense that Ms. Goons could raise if she injured
    Tommy`s
    eye, so that she could escape from him.

    v) Would your answer be different if Ms. Goons was 15 years of age and she was
    willing to have sexual intercourse with Tommy?

    vi) Marital rape is not at all recognised under s 375.
