Chapter 1. Kesavananda Bharati v.State of Kerala(1973)

 Assiduously:- Showing great care and perseverance.

Eg:- They labour assiduously for the benefit of future generations.

 Usurpation:- to seize or hold.

1. Struggle for power between the Judiciary and Legislature reached its peak in
the mid-1970s.
2. In the backdrop of this struggle Supreme Court delivered the most
monumental decision in its history on 24th April 1973.
3. The Judgement caused a shift in the balance of democratic power.
4. For Kesavananda , the Supreme court sat in Judgement for the longest
amount of time since its inception- almost for five months.
5. 800 pages Judgement- longest appellate decision of the last century.

A brief discussion of the cases which led up to the supreme courts Judgement.

6. Shankari Prasad v. Union of India- The struggle for the custody of the
constitution came from questions concerning the Right to property, which
until 1978 was a fundamental right under Article 31.
7. In Bihar, Uttar Pradesh and Madhya Pradesh, Zaminders who were deprived
of a significant portion of their land after constitution entered into force, they
filed petitions in different courts of India.
