AMENDED AFFIDAVIT

I, DELFIN V. FERNANDEZ, of legal age, Filipino, single and a

resident of No. 23 Purok Pilit I, Jalandon Street, Brgy. 6, Bacolod City, after
having been duly sworn to in accordance with law, do hereby depose and
say that:

1. I know FRANK ECHEVARRIA way back in 2010 since he was my

running coach. I also know him because we often run into each
other during running competitions in Bacolod City.

2. On October 21, 2018, I and my friend Charmie Siao went to Ayala

North Point, Talisay City to support our friend Janfred T. Javier
for his DUWA Duathlon competition.

3. Janfred was already waiting for us among the bystanders so he

could give us his bag for safekeeping. We arrived around 5:26
A.M. and Janfred handed me his bag. He was about to leave for
the gun start when Mr. Echevarria saw Charmie from the crowd.

4. Upon seeing her, he yelled at Charmie saying, “Ga ano ka di yah?

Halin ka di. Layas.” (What are you doing here? Go away. Leave.)
Taken aback at how he regarded Charmie, I addressed him and
said, “Kalma lang, Frank. Ma halin kami di ah.”

5. Since it was almost time for gun start, Charmie just ignored him.

6. At around 6: 00 A.M., Charmie and I were cycling near the gutter

towards Avida Village following behind Janfred who was running
ahead. I was a few meters behind Charmie.

7. While cycling, I saw FRANK ECHEVARRIA on his motorcycle

from the opposite direction. Recognizing Charmie, Frank
increased his speed and swerved towards Charmie’s direction.

 When he was inches away from Charmie, he instantly pulled his
motorcycle’s brakes and made a screeching sound.

8. Upon realizing this, I closed the distance between Charmie and

me. By the time Frank reached Charmie, I was a few paces behind
Charmie and heard him say to her, “Damu kana atraso sakon. Dugay
tana ikaw nabantayan. Andaman mo, may tiempo ka gid sa akon.” (You
have scored a lot of offenses against me. Beware. Your time will
come.)

9. In turn, Charmie responded and asked him what his problem was.
I then chimed in and told Frank “Hipos Frank. Tama kana ka
personal imo ya.” (Be quiet, Frank. You are taking things too
personally.)

10. However, he just glared at me and turned his attention towards

Charmie and shouted at her, “Hoy Baboy! Gaga! Layas to Baboy!”
(Hey Pig! Stupid! Go away Pig!) He then sped on with his
motorcycle and left.

11. I execute this affidavit in support of instituting cases for Other

Light Threats and Slight Oral Defamation against FRANK
ECHEVARRIA or for any appropriate criminal action as the
evidence may warrant against him.
