Magallona Vs Ermita Case Digest – G.R No. 187167 August 16, 2011

Facts
Congress amended RA 3046 by enacting RA 9522 in March 2009 demarcating the maritime baseline of the
Philippine archipelago. The former is a rectangular baseline based on the Treaty of Paris and UNCLOS I
while the latter followed a straight baseline method prescribed by UNCLOS III. Measurement of maritime
zones will begin from these baselines.

Issue
Whether RA 9522 violated Article 1 of the 1987 Philippine Constitution.

Ruling
No.UNCLOS III has nothing to do with the acquisition or loss of territory. It is just a codified norm that
regulates the .conduct of states. The RA 9522 is a baseline law to mark out basepoints along coasts,
serving as geographic starting points. Also, RA 9522 includes provisions that enforce our claims to the KIG,
SS, and Sabbah.RA 9522 is not unconstitutional, the Petition was dismissed.

RA 9522 and the Philippines’ Maritime Zones

Petitioners hold the view that, based on the permissive text of UNCLOS III, Congress was not bound to
pass RA 9522 54. We have looked at the relevant provision of UNCLOS III55 and we find petitioners’
reading plausible. Nevertheless, the prerogative of choosing this option belongs to Congress, not to this
Court. Moreover, the luxury of choosing this option comes at a very steep price. Absent an UNCLOS III
compliant baselines law, an archipelagic State like the Philippines will find itself devoid of internationally
acceptable baselines from where the breadth of its maritime zones and continental shelf is measured. This
is recipe for a two-fronted disaster: first, it sends an open invitation to the seafaring powers to freely enter
and exploit the resources in the waters and submarine areas around our archipelago; and second, it
weakens the country’s case in any international dispute over Philippine maritime space. These are
consequences Congress wisely avoided. The enactment of UNCLOS III compliant baselines law for the
Philippine archipelago and adjacent areas, as embodied in RA 9522, allows an internationally-recognized
delimitation of the breadth of the Philippines’ maritime zones and continental shelf. RA 9522 is therefore a
most vital step on the part of the Philippines in safeguarding its maritime zones, consistent with the
Constitution and our national interest.

“CORONA VIRUS”

CoVID-19 started infecting people in the city of Wuhan, China in mid-December of 2019. Within a month,
more than ten thousand people were infected and hundreds had died.People don’t expect to suffer because
of the virus that has spread and continues to spread. Many people have lost their jobs , stopped to save
thousands of people inevitably and fear because of this situation, but unfortunately many have perished
and its sad to think that our society’s suffering is still not over because we still have a pandemic experience.
We are all sacred because of the virus that spreads in our country but it is still going to us to keep fighting.
No assurance if it is to be solved, no guarantees if you are safe, no assurance who else can be infected.
Every morning that comes, with a heart asking, hopefully pandemic will end. Who is to blame for the spread
of this virus? The government that rescues or we the Filipino Citizens. We are all told to stay inside our
house, but others are still on the streets. We wish we could help ourselves, to the spread will prevent.

Although governments around the world are taking various steps to combat this virus outbreak, however
they still lack in providing facilities and proper treatment to the suffers of virus. This virus is multiplying three
fold day by day in different countries and there’s no way discovered yet to stop this fatal infection.many
individuals lost their employments as a result of lockdowns, leaving them unable to support their families.
People strapped for cash are often foreed to reduce their calorie intake while also eating less access to
healthy foods. When breadwinners lose their jobs, they become sick or die, the food and nutrition of millions
of people are endangered. Particularly severely hit one the worlds poorest small farmers and indigenous
peoples.infection illness outbreaks and epidemics have become worldwide threats due to globalization and
urbanization, and environmental change. The pandemic also has a significant impact on education.
Although many educational institutions across the globe have already made the switch to online learning,
the extent to which technology is utilized to improve the quality of distance or online learning values. As
most of the people have been rendered jobless the living conditions of the people have also been
significantly affected.

Besides, the education sector has also been effected of most of the learning institutions prefer the use of
online learning which is not effective as compared to the traditional method. With the developing countries
have been noted to stabilize slowly, while the developing countries have not been able to vaccinate most of
its citizens. The COVID19 pandemic caused a lot of damage to the world. Working with COVID19, the world
learned many lessons, and it is important to learn a lesson to prepare yourself for the next pandemic and
prevent possible pandemics.
