Sir/Madam, Sub: High Court for the State of Telangana — Notification carving out 33 Judicial Districts in the State of Telangana issued by the Government ~ Allocation of employees working in the Subordinate Judiciary in the State of Telangana to the 33 new Judicial Districts — Communication of guidelines along with option forms ~ Regarding. Ref: 1. High Court's Proceedings order Roc. No. 346/E1/2021, dated 31-05-2022. 2. G.O.Ms.No. 61, Law (LA, LA & J-Home Coruts-A2) Department, dated 01-06-2022. While communicating the guidelines for allocation of employees of the subordinate Judiciary to the newly established Judicial Districts, along with option form, I am directed to request you to obtain the option forms of the staff members from 11-07-2022 to 31-07-2022 and forward the same immediately to this Registry, to process the matter. Yours faithfully, 1 Guidelines for Allocation of Members of Telangana State Judicial Ministerial and Subordinate Service to the Newly formed Judicial Districts coterminous with the Revenue Districts (1). The Unit Heads of erstwhile Composite Judicial Districts shall prepare the data base of Courts, category wise Posts, cadre strength, vacancies and personnel as on 01-06- 2022 including the seniority lists and details of disputes in relation to seniority, among others, to allot among the new local cadres. (2). The Unit Heads of erstwhile Composite Judicial Districts while carrying aforesaid exercise, shall prepare the list of all the Ministerial Staff as per seniority in each category, to allot them among the newly carved out Judicial Districts, including those who are on leave, under suspension, on deputation, on foreign service, absconding, unauthorised absence, so as to ensure that no such staff member is left un-allotted to a newly carved out Judicial District. (3). The Ministerial Staff members who are on leave/under suspension/deputation/ Under training, foreign service, absconding, unauthorised absence, subsequent to their allotment to the newly carved out Judicial District, shall be deemed to have reported in such District and their leave/suspension/deputation would continue in the newly carved out Judicial District. (4). All Posts in Courts that existed immediately prior to 1** June, 2022 in each of the erstwhile Composite Judicial Districts, shall be allocated to the successor/newly carved out Judicial District out of such Composite Judicial District on the basis of Geographical Location and as per Telangana Public Employment (Organisation of Local Cadres and Regulation of Direct Recruitment) Order, 2018 after obtaining their preferences. That is to say the posts of the undivided Composite Judicial Districts have to be allocated between the newly carved out Judicial Districts with reference to the territorial /geographic area of the Successor Districts. The territorial posts in the Courts located in the geographical area of a Successor District go to that Successor District. (). Subject to the allocable working strength that has been fixed for new district cadres as per administrative requirements, all the posts in an erstwhile district cadre, wherever they are located, shall be taken into consideration for the purpose of allotment of that erstwhile district cadre employees. (6). Bight new districts, namely Hanumakonda, Jayashankar-Bhupalpally, Mahabubabad, Mulug, Siddipet, Mahabubnagar, Vikarabad and Rangareddy have been formed drawing areas from more than one erstwhile district. (7). (8). 2 Hence, persons holding posts in the erstwhile district cadres of Karimnager, Warangal, Khammam, Nalgonda, Mahabubnagar and Rangareddy, shall be considered for allotment, not only to the local cadres of the new districts which have been formed entirely out of the area of the erstwhile district, but also to the local cadres of neighbouring new districts, wherein certain areas of the erstwhile district are included, to the extent of posts located in such areas. In allotting Judicial Employees to the newly carved out Judicial Districts due regard shall be had to the following, namely: {a) the administrative needs of the posts in the Courts; (b) the need for the composition of balanced local cadres with reference to age and seniority groups: (c) the length of service of the persons concerned: (d) knowledge of the persons concerned of the language spoken; The allocation shall be done on the basis of cadre strength as on June 01, 2022. The Ministerial Staff shall be allocated after seeking option in the prescribed proforma from them indicating their preference to serve in any of the newly carved out Judicial District from the undivided Composite/Parent Judicial District after taking their option into consideration in the order of seniority, on the following parametres, viz., on the basis of domicile of ori ity: Those who have opted, who are Domiciles relatable to the Successor District to which they have opted, shall, in order of their seniority, be considered for allocation first. Provided: (i) that he has studied in an educational institutions or educational institutions in such local area for a period of not less than four consecutive academic years ending with the academic year in which he appeared, or as the case may be, first as appeared for the relevant qualified examination. Or b) a iii) 4 Where during the whole or any part of the four consecutive academic years ending with the academic year in which he appeared or as the case may be first appeared for the relevant qualifying examination he has not studied in any educational institution, if he has resided in that local area for a period of not less than four years immediately preceding the date of commencement of the qualifying examination in which he appeared, or as the case may be, first appeared (ii) In case where no minimum educational qualifications has been prescribed for recruitment to the post, if he has resided in that local area for a period of not less than four years immediately preceding the date on which the post is notified for recruitment on the basis of reverse seniority: If allocable posts in that category remain, others will be considered in reverse order of seniority by allotting the junior most member of the service. Ministerial Staff who are not natives/domiciles of Successor Districts will be allocated to any such successor District, on the basis of their option, subject to approval by the High Court. If the Spouse of a Ministerial Staff member is also a Judicial Employee, then the junior among them shall be allocated to the District opted by the senior of them ‘subject to the nativity/domicile. Here the rule is Junior Employee (Spouse) must follow the Senior Employee (Spouse) Cases of alleviation of extreme personal hardship of Ministerial Staff of the following categories will be exceptions to the principle: Widowed may be considered for allocation to the District to which option is exercised. Differently abled Employees of more than 70% disability may be allocated on the basis of option, as per Persons With Disabilities (P.W.D) (Equal opportunities. protection of rights and full participation), Act 1995 and Employees having mentally retarded children to a place where medical facilities are available. ‘The Ministerial Staff members who are known to be facing serious medical hardship, in cases of Cancer (self or dependent family), Open HearvBye-pass surgery, and Kidney Transplantation/Kidney failure and continuing on dialysis (self) shall be considered for allotment on special grounds on priority on the basis of option, subject to strict proof of verification as per the procedure prescribed by the State Government. 5 Process of Allocation of Members of the Service: (12). The following procedure shall be followed in the process of allocation of Ministerial Staff members: i, All Ministerial Staff members shall be asked to exercise their options in the prescribed proforma annexed to these Guidelines to the respective Principal District and Sessions Judges, in a sealed cover containing “OPTION FORM FOR ALLOCATION TO THE DISTRICT” within the prescribed period and who in-turn shall forward those applications to the High Court. ii. Scrutiny of statements made in the option forms shall be done and factual accuracy of the statements made therein shall be verified by the Unit Heads of erstwhile Composite Judicial Districts on the basis of the service record. iii, If no option is received within the prescribed time, such Staff member shall be allotted based on his/her particulars available in the Service Records subject to nativity, IV. Option once exercised cannot be changed under any circumstance. V. The High Court, after completion of distribution of posts and allotment of members of the Service, shall publish the Provisional or Tentative Allocation List in the official website of the High Court and an opportunity shall be given to members of service concerned to submit their objections or representations within 15 days from the date of publication VI. After allotment, if the spouses working under State Government, Local Bodies and State Government institutions are allotted to different cadres, and option will be provided to apply for change of cadre. Subject to administrative needs and availability of vacancies and as far as practicable, spouses will be accommodated in one local cadre. Disposal of Representations and Final Allocation: (13). Representations against the provisional or tentative allocation may be received and disposed off in the following manner: i, A member of the service who is aggrieved by his tentative allocation as prepared and drawn by the High Court would be at liberty to submit his representation to the High Court for consideration, clearly indicating the specific points of grievance which shall be disposed of within a period of 7 days thereafter. ii.
