(HRM.IV) Dept., dt.05.07.2021. 3.G.0.Ms.No.97, Fin.(HRM.1V) Dept., at.07.09.2021. 4,G.0.Ms.No.111, GA (J&RA) Dept., dt.22,10.2022. 5 Hon’ble Supreme Court Orders dated 04.01.2024 in W.P, ( C ) No.643/2015. 6.From the Registrar (ADMN), High Court for the State of Telangana, Hyderabad, Letter ROC .No.455/2024-B1, dt.24.01.2024. <<>> ORDER: Consequent on the recommendations of the First Telangana Pay Revision Commission, Government vide G.O. 1* read above issued orders revising the rates of HRA to the State Government employees as per the classification of cities, places mentioned therein. 2, In the GO 2™ read above, Orders were issued extending the benefits of HRA under Go 1 read above to the State Judicial Officers, who were drawing pay at the rates as recommended by First National Judicial Pay Commission. 3. In the GO 3 read above, the Orders issued in the GO 2” read above were kept in abeyance until further Orders. 4. In the GO 4” read above, Orders were issued revising the Pay structure to the Judicial Orficers as per the recommendations of the Second National Judicial Pay Commission as agreed and as. ordered by the Hon’ble Supreme Court of India in their Orders dated 22.07.2022. 5, The Hon'ble Supreme Court of India, in their further orders 5® read above, issued directions for payment of various allowances including HRA admissible to the Judicial Officers w.e. 01.01.2016 or at later date as specified in the orders against each allowance. 6. In the letter 6 read above, the Registrar (ADMN), High Court for the State of Telangana, Hyderabad has requested for issue of Orders extending the classification of cities and towns to the Judicial Officers in the State of Telangana regarding admissibility of House Rent Allowance on par ‘with the State Government employees ordered in the GO 1* read above. 7, Government in obedience to the orders of the Hon'ble Supreme Court referred to supra and ‘accepting the proposal of the Hon'ble High Court hereby withdraw the orders issued in the GO 3° cod above and. extend the benefits of orders issued in the GO 2” read above to the State Judicial Officers w.e-f. 01.01.2016 and further order as follows: (7.1) The Judicial Officers who are allotted official quarters, shall not be entitled to HRA; (7.2) The Judicial Officers shall have the option either to claim House Rent Allowance or opt for Residential Quarter. (7.3) The Judicial Officers, who are residing in their own house including the house of a parent of spouse, shall also be entitled for House Rent Allowance with effect from 01.01.2016, In any case, where the Judicial Officer has resided in a hired accommodation, the HRA / ‘Actual Rent which has already been paid, shall not be recovered. (7.4) If the Judicial Officer is not provided with the Government accommodation or requisitioned private accommodation within one month, then the Judicial Officer may secure private accommodation and should be paid rent in the following terms: (2) If the rent of the private accommodation is within the admissible house rent Sllowance mentioned below, no fixation of rent is required. But the concerned Judicial Officer has to certify the actual rent being paid, Contd..page..2 (b) Ifthe rent of the private accommodation is more than permissible house rent Sllowance, the rent shall be assessed by Principal District Judge with the assistance of Fair Rent Fixation Committee consisting of RDO and Superintending Engineer (R&B). (© If the difference between the permissible house rent allowance and the rent assessed is more than 15% and Principal District Judge may seek the approval of High Court for payment of the said amount unless the officer is ready to pay the differential cost.
