OMNIBUS PLEA BARGAINING OFFER

The ACCUSED, by the undersigned counsel, unto the

Honorable Court, most respectfully alleges that:

That the accused is a (Person Deprived of Liberty) and

intends to avail of plea bargaining allowed by law and
jurisprudence;

That the accused has manifested his intention to enter

a plea guilty to a lesser offense;

That the pertinent facts are as follows:

1. Crime Charged: Violation of Sec. 5 Art. II, RA 9165
(1.1407 grams, dried Marijuana leaves) ;
 2. Violation of Sec. 11, Art. II, RA 9165 (0.9719
grams, dried Marijuana leaves);
3. Prescribed Penalty:  Life imprisonment to death and
a fine ranging from Five hundred thousand pesos
(P500,000.00) to Ten million pesos
(P10,000,000.00);
4. 12 years and 1 day to 20 years and fine of Php
300,000.00 to 400,000.00;
5. Lesser Offense for which the accused is willing to
enter a plea of guilty: Section 12 of RA 9165, in
both cases;
6. Prescribed Penalty: Imprisonment ranging from six
(6) months and one (1) day to four (4) years and
Fine ranging from Ten thousand pesos (P10,000.00)
to Fifty thousand pesos (P50,000.00)
7. The least Penalty to be imposed is prayed for by the
accused and he will then file an Application for
Probation.

WHEREFORE, it is respectfully prayed of this

Honorable Court to grant thus proposal after the
prosecution shall have consented to it pursuant to Sec. 2,
Rule 116 of the Revised Rule of Criminal Procedure.

Other reliefs lawful and equitable under the premises

are likewise prayed for.
