It has come to ICA’s attention that over the years, ST Engineering Unmanned & Integrated Systems Pte Ltd (STEUIS) has removed 45 SAM cards from the access card readers within ICA Woodlands Checkpoint and changing the firmware to allow the access card readers to operate without the SAM card and without seeking official ICA approval. 2 The removal of the SAM card has a serious breach on the security access within Woodlands Checkpoint. 3 In accordance to Schedule IV of the Maintenance Contract ((MHA00004000005539)- Schedule of Deductions for Non-Compliance, Incomplete or Poor Performance, Clause 1 “Without prejudice to all rights and remedies available to the Authority or representative, the Contractor shall be liable for deductions in respect of any breaches, failures, omissions or other acts specified therein and S/N 12 “Failure to comply with instruction” - $1,000.00 per case. The amount of $45,000.00 will be deducted from the next payable monthly payment 4 STEUISis to provide an explanation by 04 May 2022 on such failure. Otherwise, deemed that STEUIS concedes to the non-compliance. All cost and expenses incurred (including any damages suffered) by the Authority shall be recoverable from the Contractor. If the contractor, after receiving an instruction from the Authority or his representative, fails to comply with it in accordance with the Schedule of Response and Down time (a) the Authority or his representative may employ and pay other persons to do whatever may be necessary to give effect thereto and may recover the amount of any cost, loss, expense or damage incurred or suffered in connection therewith; and (b) the amount of any other loss or damage suffered or incurred by the Authority as result of the contractor's default shall be recoverable from the contractor. If by reason of any accident or failure or other event occurring to or in connection with the Works, either during the execution of the Works or during the Warranty Period, any remedial or other work shall in the opinion of the Authority or his representative by urgently necessary and the contractor is unable or unwilling at once to-do such remedial or other work, the Authority or his representative may authorize the carrying out of such remedial or other work by a person other than the contractor. If the remedial or other work so authorized by the Authority or his representative is work which in the opinion of the Authority or his representative the contractor was liable to do or for which he was otherwise responsible under the Contract, the amount of any cost, loss, expense or damage incurred in carrying out the same shall be recoverable by the Authority from the contractor. ‘The Contractor shall be given seven (7) days to explain why deductions should not be imposed.
