De Lima dated 22 January 2014 (Reference No. LML-L-22414-175), the BI should not allow the downgrading of 47(a)(2) visa holders whose contracts are pre-terminated, have expired, and/or are no longer endorsed for renewal. Nevertheless, applications for downgrading filed prior to the expiration of such authorized period of employment shall be allowed by the BI with appropriate notice to the DOJ, provided that they shall be ordered to leave within fifty-nine (59) days from expiration of their PEZA authorized period of employment. Wherefore, We GRANT the application for downgrading of the special non-immigrant visa under Sec. 47(a)(2) to temporary visitor’s visa under Sec. 9(a), of applicant CHO KYEONGJONG, KOR, for a period of 59 days from 14 May 2022, or until 12 July 2022. However, pursuant to regulations, applicant is ORDERED TO LEAVE the country on or before 12 July 2022, subject to securing a regular Emigration Clearance Certificate (ECC-A) at least 72 hours prior to intended departure.
