Subject: Notice to Explain

Early morning of October 24, 2020, we received a call from Captain Jose Rickman M. Mondia
of M/V Jehan 8 informing the office that Third Engineer Cipriano Acain punched Quarter
Master Enrico Sarona that causes facial injury while docking at Pier 2, Cebu Port, Cebu City.

As reported by your crewmates, the conflict between you and Quarter Master Enrico Sarona
started when he confronted you regarding your loud voice when calling your family on your
phone at early morning which disturbs the sleep of your crewmates within your cabin. Since
then, you have been inviting Quarter Master Enrico Sarona to have a fistfight with you which
he always avoided. And just this morning, out of nowhere, you punched Quarter Master
Enrico Sarona on the face.

Furthermore,as observed by your crewmates, you are reported to have difficulty in

controlling your temper, had a very strong attitude and sometimes you act like a boss. Your
action towards Quarter Master Enrico Sarona leads to injury and it constitutes a threat to
safety which is under no circumstance permitted by this company since this already involves
the life and safety of other crew members which we are required to protect. Any complaints
or issues regarding your crewmates should be addressed to the Master of the Vessel or to
the Management.

In this regard, we are giving you this FIRST and FINAL warning that an incident of this nature
can never be repeated. Should this occur again in the future, you will be terminated.

Therefore, you are hereby required to give your written explanation within 36 hours (3days)
upon receipt of this notice.
