          It is to inform that in the reference cited 1 st, Sri Komatireddy Mohan Reddy &
Others, have applied for approval of draft layout in Sy. No.31 & 33 Parts to an extent
of 38802.02 sq mts situated at Saidapur Village, Yadagirigutta Mandal, Yadadri-
Bhuvanagiri District.
 
          The Vice-Chairman & Chief Executive Officer, YTDA, Hyderabad, vide
Lr.No.6/15/YTDA/Layouts/2015, dt.07-12-2015, has requested the Director of Town
& Country Planning, Hyderabad to deal with the matters relating to Layouts and
Buildings in the YTDA area as per the Notification No.YTDA/TP/6/2015, dated 17-08-
2015 delegating the powers issued by the authority as directed by the Government.
 
          The above proposals have been examined under the provisions of Section 13
and 14 of Telangana urban Areas (Development) Act, 1975 and also in accordance
with the statutory Master Plan / Zonal Development Plans along with existing G.Os,
Rules and Regulations, which are in force.
 
          The Vice-Chairman & Chief Executive Officer, YTDA, Hyderabad, vide
reference cited 3rd, has informed that the applicant has remitted the layout fee and
other charges of Rs.61,99,736/- along with interest of Rs.78,134/- on a30-09-2022 in
favour of VC&CEO, YTDA, Hyderabad, and forwarded the copy of the Mortgage
Deed No.22680/2022, dated 09-11-2022 along with Indemnity Bond and
Encumbrance Certificate as filed by the applicant for taking further action in the
matter.
 
          The applicant has submitted the layout plan with the proposed road network,

plotted area and open spaces in the said layout area to an extent of 38802.02 cents
along with existing measurements of the plotted area on ground.  The same is
hereby technically approved after making certain modifications in Draft TLP No.3149/
Saidapur/2022/007 with 129 plots and other facilities and hereby communicated
subject to the following conditions:
 
1. The applicants shall not be permitted to sell the plots and area which is
mortgaged in favour of YTDA vide Mortgage Deed No.22680/2022, dated 09-
11-2022, i.e., Plot No.61, 62, 63, 64, 65, 66, 67 & 68 situated at Saidapur
Village, Yadagirigutta Mandal, Yadadri-Bhuvanagiri District.
2. The draft layout now issued does not exempt the lands under reference from
the purview of Urban Land Ceiling Act, 1976 / A.P. Agricultural Land Ceiling
Act, 1973.
3. The permission of developing the land shall not be used as proof of the title of
the land.
4. The applicant shall be solely responsible for the development of layout and in
no way, YTDA will take up development works.
5. The Deed of Mortgage by conditions sale executed by the applicants in favour
of YTDA is purely a measure to ensure compliance of the conditions of
development of infrastructure by the applicants / developers and YTDA is no
way accountable to the plot purchaser in the event of default by the
applicants / developers.
6. In case, the applicant / developer fails to develop the layout with the
infrastructure facilities as specified by YTDA, the area so mortgaged in favour
of YTDA shall be forfeited and also YTDA is liable to take criminal action
against such applicants / developers as per provisions of YTDA Act.
7. The layout development work consist of road formation with back top, storm
water drains, providing of underground drainage lines and common septic tank
/ STP, internal water supply pipelines and overhead tank, assured water
supply source, providing electrical supply lines along with street lights,
transformer, avenue plantation, park development and rain water harvesting
pits.  The details are as follows:
a. Levelling with suitable gradient and formation of all roads with proper sub-
surface and camber, kerbed stones, metalling of the carriageway, side drains /
gutters and central medians (for roads 18 mts and above).
b. Black topping or developing the carriageway with cement concrete (as per BIS
code of practice) of all roads including the main approach road up to the
nearest existing public road.
c. Development of drainage and channelization of nalas for allowing storm water
run-off.  These may be channelized in accordance with the drainage and width
requirements and in such a way as to conserve or harvest the water in nearest
water body or public open space, etc.
d. Undertake street lighting and electricity facilities including providing of
transformers.
e. Provision of independent sewerage disposal system and protected water
supply system including OHT and sumps.  These shall be in exclusive area
over and not part of the mandatory open spaces.
f. Undertake underground ducting of all utilities and services lines either under
the footpaths or central median of the roads as the case may be with proper
provisions at junctions and crossings, etc.

g. Undertake greenery in the Scheme / Layout including avenue plantation in


public open spaces as per norms prescribed with a view to enhancing the
environmental quality.
h. Construction of low height compound wall with ornamental iron grill to the
open spaces.
8. The layout applicants are directed to complete the above developmental works
within a period of THREE (3) YEARS as per G.O.Ms.No.33, dt.24-01-2013 and
submit a requisition letter for release of mortgaged plots / area, which is in
favour of YTDA and for approval of final layout duly enclosing letter of Local
Body with regard to roads, open spaces taken over by the Local Body.
9. The layout applicants shall display a board at a prominent place in the above
site showing the layout pattern with permit L.P. number and with full details of
the layout specifications and conditions to facilitate the public in the matter.
10.The Executive Authority shall not approve and release any building
permission or allow any unauthorized developments in the area under
mortgage to YTDA in particulars, and in other plots of the layout in general,
until and unless the applicants complete the developmental works and then
gets released the mortgaged land from YTDA and release of final layout.
11.The Executive Authority should ensure that the open space shall be
developed by the applicants along with other developments with ornamental
compound wall and grill as per sanctioned layout plan before it is taken over
by the Executive Authority.
12.The Executive Authority shall collect necessary fees and charges as per rules
in force.  He shall also ensure that the area covered by roads and open space
of the layout is handed over by the applicants through Registered Gift Deed,
free of cost, before release of the layout to the applicants.
13.The permission does not bar any public agency including YTDA to acquire the
lands for any public purpose as per law.
14.If any dispute / litigation arise in future regarding the ownership of a land, the
applicants shall be responsible for the settlement of the same, YTDA /DT&CP
or its employees shall not be a party to any such disputes / litigations.
15.The YTDA / DT&CP reserves the right to cancel the Draft Layout Plan
permission if it is found that permission is obtained by misrepresentation or by
mistake of facts or incorrect boundary measurements and the applicants /
developers shall be solely responsible for the same.
16.The applicants are not permitted to construct the compound wall around the
layout site and on the roads as per the layout so as to provide the access road
to the adjacent lands.
17.The applicants / developers should hand over the open space area to an
extent of 2829.54 sq mts, Social Infrastructure area to an extent of 569.19 sq
mts, roads area to an extent of 10579.37 sq mts and the utilities area to an
extent of 265.88 sq mts to the Local Body at free of cost by way of Registered
Gift Deed before release of final layout from YTDA.
18.The applicants are the whole responsible if any discrepancy / litigation in
ownership documents and YTDA is not responsible and approval of layout
plans shall be deemed to cancelled and withdrawn without notice and action
will be taken as per law.
19.Electrical wires passing through the plots, if any, are to be shifted along road
margin before approaching this office for final layout.
20.The Panchayat Secretary, Saidapur Gram Panchayat shall ensure that no

Government land / Forest land is encroached upon by the applicants.


21.The applicants shall register the proposed project with TS-RERA as per the
Telangana Real Estate (Regulation and Development) Rules, 2017 issued
vide G.O.Ms.No.202 MA, dt.31-07-2017.
