RULES OF ADMISSIBILITY
CHAIN OF CUSTODY
The purpose is to guaranty the integrity of the physical evidence and prevent
introduction of evidence which is not authentic. It is to ensure that the
integrity and evidentiary value of the seized item are preserved.
The links are the people who actually handled or had custody of the object.
Each of the links in the chain must show how he received the object, how he
handled it to prevent substitution and how it was transferred to another.
Sec 21 of Ra 9165
(1) The apprehending team having initial custody and control of the dangerous
drugs, controlled precursors and essential chemicals,
instruments/paraphernalia and/or laboratory equipment shall, immediately
after seizure and confiscation, conduct a physical inventory of the seized items
and photograph the same in the presence of the accused or the person/s from
whom such items were confiscated and/or seized, or his/her representative or
counsel, with an elected public official and a representative of the National
Prosecution Service or the media who shall be required to sign the copies of the
inventory and be given a copy thereof: Provided, That the physical inventory
and photograph shall be conducted at the place where the search warrant is
served; or at the nearest police station or at the nearest office of the
apprehending officer/team, whichever is practicable, in case of warrantless
seizures: Provided, finally, That noncompliance of these requirements under
justifiable grounds, as long as the integrity and the evidentiary value of the
seized items are properly preserved by the apprehending officer/team, shall not
render void and invalid such seizures and custody over said items.

B. DOCUMENTARY EVIDENCE
Public documents
(a) The written official acts, or records of the official acts of the sovereign
authority, official bodies and tribunals, and public officers, whether of the
Philippines, or of a foreign country;
(b) Documents acknowledged before a notary public except last wills and

(c) Public records, kept in the Philippines, of private documents required by law
to be entered therein.
Private documents are all other documents which are not included in the
definition of public writings.
Example. Art. 749. In order that the donation of an immovable may be valid, it must be
made in a public document, specifying therein the property donated and the value of the
charges which the donee must satisfy.
The acceptance may be made in the same deed of donation or in a separate public
document, but it shall not take effect unless it is done during the lifetime of the donor.
(d) When the original is a public record in the custody of a public officer
or is recorded in a public office; and

Section 9. Party who calls for document not bound to offer it. — A party who
calls for the production of a document and inspects the same is not obliged to
offer it as evidence. (8)
However, a party may present evidence to modify, explain or add to the terms
of the written agreement if he or she puts in issue in a verified pleading:

1. Qualification of Witnesses
Section 21. Witnesses; their qualifications. - All persons who can perceive, and
perceiving, can make known their perception to others, may be witnesses. (20a)
(a) The husband or the wife, during or after the marriage, cannot be
examined without the consent of the other as to any communication
received in confidence by one from the other during the marriage except
in a civil case by one against the other, or in a criminal case for a crime
committed by one against the other or the latter's direct descendants or
ascendants.

Section 35. Similar acts as evidence. - Evidence that one did or did not do a
certain thing at one time is not admissible to prove that he or she did or did
not do the same or similar thing at another time; but it may be received to
prove a specific intent or knowledge, identity, plan, system, scheme, habit,
custom or usage, and the like. (34a)
Section 36. Unaccepted offer. - An offer in writing to pay a particular sum of
money or to deliver a written instrument or specific personal property is, if
rejected without valid cause, equivalent to the actual production and tender of
the money, instrument, or property. (35)
5. Hearsay
A statement is not hearsay if the declarant testifies at the trial or hearing and
is subject to cross-examination concerning the statement, and the statement is
(a) inconsistent with the declarant's testimony, and was given under oath
subject to the penalty of perjury at a trial, hearing, or other proceeding, or in a
deposition; (b) consistent with the declarant's testimony and is offered to rebut
an express or implied charge against the declarant of recent fabrication or
improper influence or motive; or (c) one of identification of a person made after
perceiving him or her. (n)
