• Register Filipino trademarks
owned by MSMEs under the
Madrid Protocol
• Technical and financial
assistance
INCENTIVE PACKAGE BACKGROUND
• Madrid Outbound (International Application)
– Less than 500 filings since 2012

• Reasons for low filings:


– Cost
– Unfamiliarity with Madrid Protocol
– Complicated process
COST EFFECTIVE

• Hotel accommodation
• Agent’s fees
• Other travel-related fees
CRITERIA
• classified as MSME by the DTI
• valid and existing registered mark with the
IPOPHL
• business belongs to DTI's priority industries
• significant potential or actual market abroad
• no pending or registered trademark abroad
Cont. CRITERIA
• in business for at least one (1) year or with
limited financial capability or other similar
conditions

• Will cover additional expenses required other


than IPOPHL's Handling Fee (Php2,617.92)
that are not covered by a sponsoring
organization, association or institution
GENERAL CONDITIONS
• TM Applicants:
– Submit to IPOPHL Request for Waiver of Fees
and Undertaking :
• certified by IPOPHL and evaluated by DTI pursuant to
the criteria

• IPOPHL:
– match the business of the applicant with an
organization, association, institution or
individual who will shoulder the fees
Cont. GENERAL CONDITIONS
• TM Applicants:
– must submit proof of actual use of the mark in
the Designated Contracting Parties (DCPs)
within one year from the date of the
international registration.

• one-time privilege, applicant who fails to actually


use the mark within the one-year period in the said
DCPs shall disqualify him to avail of the Fee Waiver
for subsequent applications

ROLE OF IPSOS
1. Assist:
• applicants in conducting trademark search
• completion of Form MM2 (Madrid Protocol Application
Form)

2. Submit a monthly report of all applicants endorsed


under the "Juan for the World" Incentive Package and
the status of their international applications/registrations,
as may be applicable, to the Office of the Director of
Trademarks and the Supervising Deputy Director
General

REFERRAL BY THE BOT DIRECTOR

• while the process of International Registration is


ongoing, the BOT Director may refer the MSMEs to
DTI or other private partners for capacity building
seminars, like branding, marketing, etc.

• this program does not end in the mere filing of the


MM2 but also in capacitating the MSMEs
