The project aims to address unsustainable watershed management in four priorty upper river basins (URBs), namely, Chico Upper River Basin in the Cordilera Administrative Region (CAR), Wabig- Inabanga River Basin in the island of Bohol (Region Vil), Bukidnon Upper River Basin in Norther Mindanao (Region X), and Lake Lanao River Basin in the Autonomous Region of Muslim Mindanao (ARMM). With particular focus on indigenous peoples and resource-poor communities, the project further aims to reduoe and reverse degradation of watersheds and associated environmental services caused by forest denudation and unsustainable farming practices. The DENR signed a memorandum of agreement to partner with the Department of Trade and Industry {OTI) on the implementation of INREMP particularly on the component on Livelihood Enhancement ‘Support 2 (LES 2). The main objective of the LES 2 is to provide strategic enabling conditions that will sustainably increase the sales from commodities produced by upland farmers, smalholders and micro eirepreneurs in the covered areas through the introduction of value adding, entrepreneurial skls and ‘market linkages. Under the LES 2, there are four (4) sub-components carried out, to wit: 1. Institutional Strengthening for Coops/MEs & Partner Agencies, 2. Establishment and Operation of Shared Service Facilities (SSF), 3. Enterprise Start-up and Strengthening, and 4, Project Management Project period is expected to run from June 2018 to December 2021. ‘The infrastructure under component 2 aims to provide the chosen People’s Organizations a permanent area to house the Shared Services Facilities (Equipment) to be provided and forthe chosen People's Organization (PO) to carry out their daly operations. To be able to construct the proposed one-storey with roofdeck heitoom rice processing center for the People's Organization’ Beneficiary (Geang Tribal Unity for Development) of DTI-CARI DTHXalinga under the INREMP-LES 2 Project in accordance with the technical construction documents (buikling plans, program of works, technical specification, PERT-CPM/ construction schedule and the like) provided by the implementing agency within the agreed amount, time and schedule; 2. To provide penalties in case of breach of contract. IV. APPROVED BUDGET FOR THE CONTRACT: ‘The Approved Budget for the Contract (ABC) amounts to ONE MILLION NINE HUNDRED ‘SIXTY FIVE THOUSAND AND TWO HUNDRED TEN PESOS ONLY (®1,965,210.00), inclusive of all applicable taxes and expenses. V. SCOPE OF WORKS/ DELIVERABLES: ‘A. The CONTRACTED PARTY (CONTRACTOR/ SUPPLIER) shalt: 1. Review the building construction documents intally prepared by the Service Provider contracted by the Department of Trade and Industry ~ CAR) Kalinga forthe construction of the proposed one-storay with roofdeck heirloom rice processing center. ‘© The contacted party shall take into consideration the technical construction documents’ building construction documents (building plans, program of works, technical specifications, PERT-CPM) construction schedule and the like) and prepare his/her bid aligned wit the said documents. 2. Undertake the construction of the proposed one-storey with roofdeck heirloom rice processing center within the agreed upon timeframe, at the above mentioned project location and_with the amount agreed upon by the CONTRACTING PARTY and the CONTRACTED PARTY in accordance with the technical construction documents (bulking plans, program of works, technical spectications, Program Evaluation and Review Technique - Critical Path Method (PERT-CPMY construction schedule and the like) and by all applicable provisions specified on the succeeding general codes and standards and special terms of conditions. 3. Commence work upon receipt of Notice to Proceed along with the issuance of the respective LGU's Bulding Permit for the project. The building construction shal be ‘completed within 60 calendar days or ess from the date of effectivity ofthe agreement. 4. Prepare documentary requirements required prior, during and after the building ‘construction (like the DOLE approved Construction Safety Health Program, among others). He/ she shall also render services to the Contracting Party in the processing ‘and completion of applicable permits to be obtained prio, during and afer the building construction (such as but not limited tothe Building Permit and Occupancy Permit). 5. Familiarize himself with the general codes and standards and spacial terms of condfons ‘stated on the succeeding items for observance before, during and after the construction afte peposedan-seey wih kek ebm to proces cr, 6. Define the scope and limitation of work as specified inthe construction specifications. 2. Provide necessary data that would enable the CONTRACTED PARTY to satisfactorily proceed wi the construction of the proposed one-storey with roofdeck heirloom rice processing center. 3. Ensure payment of the agreed amount at the agreed timeframe as stipulated on item Villofthis TOR, 4, Review! evaluate’ monitor the output of the CONTRACTED PARTY. The CONTRACTING PARTY shail have the right to demand corective actions from the CONTRACTED PARTY if works are not satisfactorily carried out. 5. Issue Certficate of Acceptance per this Terms of Reference (TOR) and Bidding Documents. This wil form part of the prerequisite documents and other pertinent documents for payment, 6. Assign a provincial and regional officer to whom the CONTRACTED PARTY shall ‘coordinate with in the performance of his tasks. VI. For areas under the Modified Enhanced Community Quarantine (MECQ): In addition 10 those allowed and enumerated construction projects under Section 2 of these Guidelines, other essential and priority pubic and private construction projects shall be allowed, subject to compliance with the DPWH construction safely guidelines: Provided, however, that small scale-projects as defined by the DPWH shall not be allowed. (page 14, item 14) For areas placed under the General Community Quarantine (GCQ): ‘Al public and private construction projects shal be allowed, but with strict compliance to the construction safety guidelines issued by the DPWH for the implementation of infrastructure projects during the COVID-19 pandemic. (page 17, Item 8). Forareas placed under the Modified General Community Quarantine (MGCQ): A\l public and private construction projects shall be allowed subject to strict compliance with the construction safety guidelines issued by the DPWH forthe implementation of infrastructure projects during the COVID-19 pandemic. (page 22, Item 10). ._ROG-HO-MEMO-463/33 dated May 13, 2020 (Meeting of the NLIU with the ADB AND DENR-NPCO) For dil works, local contractors should engage the members ofthe community by sourcing their laborers from within the community where the building or processing center will be constructed, instead of sourcing them from other municipalities. Relative to the Community participation in the procurement of civil works, it should be noted that the ADB requires prior review of the documents before contract signing commences. In case the bid is awarded to a local contractor, the local contractor should source at least 30% of its labor requirement from the community where the building or processing center will be constructed. |. Measures” signed on May 16,2020 In the case of contracts for construction projects and for security, janitorial and other services, the cost of COVID-19 prevention and contsol measures shall be bome by the principals or cients of he construction/ service contractor. Provisions of existing contracts inconsistent herewith shall be deemed amended accordingly. No cost related or incidental to COVID-19 prevention and ‘control measures shall be charged directy or indirecty to the workers. The DOLE Regional Offices shall provide appropriate assistance to all employers and contractors: oF subcontractors to facitate compliance to issued COVID-19 workplace prevention and contol by the Department of Trade and Industry (DT), Department of Health (DOH), Department of Labor and Employment (DOLE) and Department of Public Works and Highways (DPWH). 5. eT Oe a Oe etcann tf rduarence Revised Construction Safety Guidelines for the Implementation of Infrastructure Projects anh during the COVID-19 Public Health crisis, repealing Department Order No. 35, Series of 2020 DTI-CAR shall mainly adopt the Implementing Rules and Regulations set by the DPWH DO No. 39 Series of 2020. Therefore, the CONTRACTED PARTY shal strcly abide by the rules stipulated on this Department Order. ‘Annex A ofthis TOR shows the Quarantine Pass (QP) format thatthe Implementing Office (10) shall be issuing to the individual qualified personnel of the concessionaires, contractors, subcontractors and suppliers, clearly stating the identification, designation, nature of work, validity and destination iis understood thatthe QP refered in these Guidelines! TOR shall cover transit of personnel from (2) MGCQ, GCQ, MECO area to ECQ area, and vice versa, and (b) an ‘area not under community quarantine to a MGCQ, GCQ, MECO, ECO area, and vice versa. ‘Annex B of this TOR shows the Workers’ Records Log Format that will serve as the personal records of all personnel necessary for contact tracing. This shall be submitted by the ‘concessionaires, contractors, subcontractors. and suppliers to the DTI 10 and shall be resubmitted and updated monthly or as the need arises. ‘Annex C of this TOR shows the COVID-19 Surveillance Fil-up/ Checkiist Forms for daly monitoring of the pre and post work heath conditions of workers by the concessionaires, contractors, suboontractors and suppliers including, but not limited to temperature, health and exposure monitoring, as preventive measures. Personnel with manifestations or symptoms relative to COVID-19 shall be immediately isolated and quarentined for fourteen (14) days and if necessary, brought to the nearest DOH COVID-19 treatment facility under sbict confidentiality and privacy. Proper protocols in accordance with the DTI and DOLE Interim Guidelines on Work Pace Prevention and Control of COVID-19 shall likewise be strcty observed. A dally heatth ‘monitoring report shall be prepared and submitted by the Safety Officer to the DT 10. Annex F of this TOR shows the copy of the certification that concessionaires, contractors, and subcontractors must submit to the DTI 10, LGU, or implementing Govemment Agency, Page Sof 18 mae Instrumentalty or GOCC, as the case may be. This certification under oath expresses that they have complied and shall continue to comply withthe provisions ofthese Guidelines within fifteen (15) days from commencement of work. 6. Construction Environmental Code Of Conduct (CECC) To provide a minimum set of guidelines to avoid, minimize and mitigate environmental impacts: during construction, the CONTRACTOR shall conduct weekly monitoring of compliance with the CEC, and include a section in the monthly report to the Department of Environment and Natural Resources (DENR) and Department of Agriculture (DA), in the case of the Cordillera ‘Administrative Region. The report formats defined in Annexes D and E shall be used in the ‘monthly reporting to the Project Monitoring Unit (DTI). 7. 2015 Project Administration Manual (PAM) Of The Asian Development Bank ‘VIN PAYMENT SCHEDULE The agreed amount between the CONTRACTED PARTY AND CONTRACTING PARTY shall be paid to the CONTRACTED PARTY to cover all applicable charges for the construction services rendered. Net Contract Price shall refer to 90% of the Contract Price or 90% of the amount bidded by the Contracted Party. Where the CONTRACTED PARTY refuses or fails to satisfactorily complete the work within the specified contract time, plus any time extension duly granted and is hereby in default under ‘the contract, the CONTRACTED PARTY shall pay DT! for liquidated damages, and not by way ‘of penalty, an amount, as provided in the conditions of contract, equal to atleast one tenth (1/10) ‘of one (1) percent of the cost of the unperformed portion of the works for every day of delay. ‘Should the amount of liquidated damages reach 10 peroant of the contract amount, DT! shall at its own discretion terminate the contract without prejudice to any further action it may take to Tecover whatever losses incurred due to the non-performance of the CONTRACTED PARTY. 2. To be ented to such quidated damages, DTI does not have to prove tht it has incurred actual damages. Such amount shall be deducted from any money due or which may become due the CONTRACTED PARTY under the contract and/or collect such liquidated damages from the retention money or other securities posted by the CONTRACTED PARTY whichever is convenient to DTI. 3. The CONTRACTING PARTY shall have the right to blacklist the CONTRACTED PARTY in case of pre- termination, X.
