Terms and Conditions

(A)CUSTOMER (as named in the front of this Agreement and hereinafter "Customer")s OBLIGATIONS: Customer :-
1. Understand that this Internet service is provided by 'PROTOACT DIGITAL NETWORK PVT. LTD. 'which is governed by laws of the India Government(DOT) and
other applicable Licenses customer shall therefore ensure compliance to all and such License conditions & laws and also ensure that Internet service provided by
PROTOACT DIGITAL NETWORK PVT. LTD, any infringement would result in termination of service without any notice. This will be in addition to any action taken
by the Government or under the Law. Understand further that the Internet contains unedited materials some of which are sexually explicit or may be offensive to soine
people. Customer accesses such material at his own risk. PROTOACT DIGITAL NETWORK PVT LTD has no control over and accepts no responsibility whatsoever
for such materials.
2. Understand that customer is fully responsible for any misuse of IP/IP's allotted to him by PROTOACT DIGITAL NETWORK PVT. LTD.
3. The CPE(Customer Premises Equipment) provide by the company is to be taken care off. The Company will not be liable for any damage or misuse of the CPE.
4. Shall also not use the services for any anti-national activities.
5. Will allow person of PROTOACT DIGITAL NETWORK PVT. LTD. so authorized to install equipment cable for the connectivity.
6. Will pay to PROTOACT DIGITAL NETWORK PVT. LTD. For taking service at the prescribed rate, as described on the face of this form. Customers will be
informed in written, through any mean of communication possible, in case the rates are revised. payment be received by the due date to avoid
suspension/disconnection of the service. Non-receipt of the invoice by customer cannot be a reason for non-payment.
7. Understand further that under no circumstances shall PROTOACT DIGITAL NETWORK PVT. LTD. its affiliates or its contractors be liable for any direct, indirect,
Incidental ,special, punitive or consequential damages that result in any way from customer's use of or inability to use service or nay part thereof, or Customers
reliance on or use of information , service or merchandise provided on or through Service, or that results from mistake, omission, interruption, errors, defects, delays
in operations, or transmission , or any failure of performance.
8. Understand that the date of placement of order is deemed to be the date of connection.
9.Understand that the customer will make payment, for services, in favor of PROTOACT DIGITAL NETWORK PVT. LTD. payable at Ranchi . If the payment is made
in cash, Customer must insist to have a proper/ valid receipt against cash payment and submit the same with PROTOACT DIGITAL NETWORK PVT. LTD. as an
when requested by PROTOACT DIGITAL NETWORK PVT LTD.
10. Shall undertake all necessary document of customer to make the service operational beyond the service provided by ‘PDNPL’.
11. Understand that CPE is sold by 'PDNPL' to customer for providing connection in case of defect is the equipment PDNPL has discretion to decide whether a device
is to repaired or to be replaced. Customer undertake not to obstruct or prohibit PROTOACT DIGITAL NETWORK PVT. LTD. to take one equipment or any part of it
from customer’s premises thereof for rectification to its service when deemed so necessary by PDNPL at its sole discretion. All defective parts after replacements
become the property of PROTOACT DIGITAL NETWORK PVT LTD. Customer having no right over them whatsoever.
12. Shall allow necessary access for maintenance activities of such equipments whenever required by PROTOACT DIGITAL NETWORK PVT. LTD. at it's premises.
13. Will not resell the bandwidth / connectivity provided by PROTOACT DIGITAL NETWORK PVT LTD. until and unless otherwise agreed separately with
PROTOACT DIGITAL NETWORK PVT LTD. in writing as an addendum to this agreement.
14. Understand that civil engineering works, if any, shall be responsibility of customer. Customer will ensure the necessary formalities for undertaking such work are
obtained from the property owners and Government authorities, whenever necessary.
This agreement is valid till the customer pays for the connection or is terminated by PROTOACT DIGITAL NETWORK PVT. LTD. or customer as per the clause and
“Disconnection Terms" mentioned elsewhere in this Agreement .PROTOACT DIGITAL NETWORK PVT. LTD. can terminate this agreement by giving one month
notice. Customer is liable to pay service fee for the balance of the term if he desires to terminate or terminates this Agreement in Addition. Customer is also liable to
pay one month service fee if the Customer terminates the the agreement without providing adequate notice.
[B.] DISCONNECTION TERMS
A) PROTOACT DIGITAL NETWORK PVT. LTD. retains the right to terminate this agreement immediately in case of customer's default under clause 1,2,3,4, and 6
of customer obligation.
B) Any loss of business suffered by the customer due to disconnection affected under clause.
C) Above will be his own responsibility and so borne by him.
D) Above will not require any notice .The Laws of India shall govern this agreement. The parties shall submit to the exclusive jurisdiction of courts in Ranchi. The
customer shall abide by all the applicable laws, rules.
E) Regulation and shall keep PROTOACT DIGITAL NETWORK PVT. LTD. indemnified against any damage, loss and claims arising out of its negligent act or
omissions. The customer must indemnify PROTOACT DIGITAL NETWORK PVT LTD. against any claims or legal proceedings arising from provision of service,
which are brought against PROTOACT DIGITAL NETWORK PVT. LTD. by anyone using service under or through Customer because:
1. Service is used in breach of terms/conditions in this Agreement.
2. Service is faulty and cannot be used by a third party.
15. Customer cannot Downgrade any plan/Tariff before 3 month from Date of installation.
16. If customer wants to suspend or disconnect the services One month prior information should be made to our company at info.protoact@gmail.com
17. If the customer wants to change plan they have to inform before 25th of every month. The plan will be upgraded or downgraded in the 1st week of every month.
[C.] FORCE MAJEURE
PROTOACT DIGITAL NETWORK PVT LTD. shall not be responsible or liable for any failure on its part to fulfill its obligations contained herein if such failure of a force
majeure event. Force majeure shall mean such unforeseeable occurrences beyond the reasonable control of PROTOACT DIGITAL NETWORK PVT. LTD. such as:
1. Act of God, natural catastrophes , frequency interference from external source , epidemics, earthquakes;
2. War or War-link conditions, mobilization, revolutions, or riots, acts of public enemy, sabotage, terrorism:
3. Restriction by or actions, omission or intervention of Indian public authorities (Including but not limited to chants in laws, regulations or import/export, security
restriction).
