Hitachi Annual Maintenance Contract

PREVENTIVE - Split and Window Air Conditioner:


The routine servicing will cover the following:
• Checking operational performance parameters of Machine.
• Cleaning of blower, Condenser fan, Air filter, Evaporator coil, Condenser Coil & parts.
• Any extra Services other than what is mentioned in the contract would be on Chargeable basis.

Under the said AMC, Customer can avail Three (3) Services in a year for each unit by registering through
Mobile App, Web or Customer care centre. These services will be provided by Company’s engineer or
through its authorised service centre during the validity of this Contract.

General Terms & Conditions applicable for Hi-Wall Split, Cassette, Window Air Conditioner and
Refrigerator (hereinafter individually referred to as “Unit”):

1. Johnson Controls-Hitachi Air Conditioning India Limited (hereinafter referred to as “JCH-IN”


or “Company”) shall arrange its Authorized Representative to attend the Unit, for any problems with
the unit as and when called upon. The complaint will be attended within three (3) working days from
the date it is notified to the Company.
2. The Company shall arrange to undertake repair of the Unit. If required, the Unit shall be taken to
the Company’s service station.
3. Customers residing outside the municipal limits of the City / town of the Company’s service centre
shall have to bring the unit at its /his / her own expense to the service centre.
4. In case the service contract is to be entered into after the expiry of warranty period or of previous
contract, the contract will be accepted subject to checking of the Unit by the Company's
representative and verifying that it is in working condition. In case Unit is found defective and any
repair needs to be done, then it will be repaired first and taken into contract and the cost (labour and
parts) shall be borne by the customer.
5. Any parts/services not covered /mentioned hereinabove in any type of the services shall be on
chargeable basis. The cost of such service/part shall be paid in advance by the customer.
6. Any defect in electrical installation outside the Unit is not covered under this service and same shall
be rectified by the customer including electrical supply points and accessories (viz plug points, MCB
etc.) through its Electrical Contractors. Any damage caused to the Unit due to faulty electrical
installation (wire fluctuation in electric supply) shall be rectified by the customer.
7. This contract covers only those Unit installed at the address mentioned on care pack contract. In
case of shifting / reinstallation of the Unit the customer shall intimate the same to the Company.
Shifting activity (dismantling and re-installation) of the said Units will be carried by the Company,
however the cost of the same (shifting) will be borne by the customer. The Company shall not be
liable or responsible for any damage to the Unit including the parts. If the Unit is shifted by the
customer through unauthorized person or sold to third party and shifted by such third party through
unauthorized person then in that case notwithstanding anything to the contrary contained in this
contract, this contract shall stand terminated at the option of the Company and no refund shall be
permissible for the remainder period.
8. During the subsistence of this contract in case of change in location, the Company reserve the right
to withdraw from this contract for maintenance due to non-availability of its service centre in the
particular location. In such event the Company shall refund the balance amount of the contract to
the customer.
9. If either parties decides to terminate the maintenance contract before the half tenure completion of
the contract, a pro-rata fees shall be refunded after deduction of tax for the unexecuted period (full
month). Post expiration of half tenure no refund shall be applicable.
10. The Company reserves the right to terminate the contract in case the Unit is
serviced/repaired/handled in any manner by any other/third party without prior information to the
Company, serial no of the unit is altered, removed or defaced, neglect or cause other than normal
use.
11. This contract doesn’t cover the defect caused by household pets, rats, cockroaches or any other
animal or insects. Service charges including part replacement due to above reason shall be borne
by the customer.
12. The maintenance contract is not transferable by the customer and change of ownership brings the
contract to an end.
13. FORCE MAJEURE CLAUSE: The Company shall not be liable for any break or non-performance
or delay in carrying out any of the obligations contained in this maintenance service including
servicing / repairing of the Unit as a result of strike, epidemic, pandemic, lockout, industrial labour
disturbance, fire, accidental damage, restriction imposed by the government, circumstances
beyond the Company’s control, any act of God, riot, any war or any condition arising from similar
causes beyond the Company’s control.
14. The customer shall strictly abide by the ethic policy and code of conduct as laid down by the
Company.
15. The customer agree to maintain the confidentiality and shall not disclose any information of the
Company including terms and conditions of this contract to any third party except that is required
under the law subject to immediate prior written notice given to the Company and shall furnish
only such portion of the information that the customer is advised, by its/his/her legal counsel in
written form, as may be legally required.
16. The Company reserves the right to modify the terms and conditions of this contract at any time
without assigning any reason
17. The Company/authorized representative of the Company shall not be liable for any
consequential/liquidated damages or losses due to failure or inadequate performance of Unit for
any reason, whatsoever, under this contract.
18. This contract shall constitute the entire agreement between the parties as to the subject matter hereof
and it cancels and replaces any prior oral or written agreement/document on the same subject.
19. This contract shall be a contract under the laws of India and for all purposes shall be governed by and
construed and enforced in accordance with the laws of India.
20. In case of any dispute or difference between the parties with regard to the terms and conditions of
this contract or any such services, the parties shall try to settle the same amicable within themselves.
If the problem still persist the parties shall be free to approach court of Ahmedabad.
