After the formation of State of Telangana various Real Estate development agencies
have been representing to the Government that some of the existing building nibs framed by
the State are not conducive to reach the real estate growth potential of urban areas In the State
They therefore requested in the interest of and to facilitate Ease of Doing Business to smnplify
the existing building rules, give some concessions and remove certain bottle necks in the
existing building rules to promote Investment In Real Estate Sector in the State of Telangana.

Government after careful examination of the matter have felt that there is a need to take
some steps to reform real estate sector in 'Ease of Doing Business' to encourage this sector to
provide emptoyment and economic growth. Therefore, to encourage the real estate sector to
provide employment and economic growth Government hereby issues the following
amendments to the Building Rules 2012 which were issued in G.O.Ms.No.16a, MA,
dt.07.04.2012 read with G.O.Ms.No.245. MA, dt:30.06.2012.

NOTIFICATION

In exercise of the powers conferred by section 585 read with section 592 of the
Greater Hyderabad Municipal Corporation Act, 1955; proviso under sub-section (1) read
with sub-section (2) of sections 14, 32. 46 and 58 of the Telangana Urban Areas
(Development) Act, 1975, section 56(1) of the Hyderabad Metropolitan Development
Authority Act, 2008, section 18 of the Telangana Municipal Corporations Act, 1994;
section 326 of the Telangana Municipalities Act, 1965, the Government of Telangana
hereby makes the following amendments to the Building Rules 2012 which were Issued
in G.O.Ms.No.168, MA&UD (M) Dept., dt:07.04.2012 read with G.O.Ms.No.245, MA,
dt:30,06.2012.

AMENDMENT - 1

In Rule 3, the sub rule (11)(1) shall be substituted with the following:

(ii)(1) 50 m from the boundary of the river within the Municipal Corporation /
Municipality / Nagara Panchayat / HMDA / UDA limits. The boundary of the
river shall be as fixed and certified by the Irrigation Department and
Revenue Department.

AMENDMENT -2

In Rule 3, in sub rule (a)(iiI)(2) following shall be added after the words 'wherever
feasible':

12 feet walking/ cycling track within the 30 m buffer strip may be provided.

AMENDMENT -3

In Rule 3, in sub rule (c)(ii) following shall be added after the words as defined in the
Master Plan':

Wherever the road Is not feasible below the HT line, green belt can be
provided below the HT line and this will be in addition to 10% open space ,
to be provided as per rules and for such cases, TORs as applicable to rood
widening cases shall be given.

AMENDMENT-4

In Rule 3. sub rule (b) and (f) shall be substituted with the following:

(b) In case of sites abutting to railway property, NOC from Railway authorities
need not be Insisted. However it will be the responsibility of the applicants
to follow the applicable rules as prescribed by the Railway authorities in
their rules.

(U In case of sites abutting to Defence establishments, NOC from Defence


authorities need not be insisted. However it will be the responsibility of the
applicants to follow the applicable rules as prescribed by the Defence
authorities In their rules.

AMENDMENT -5

In Rule 3, under sub rule co after the clause (v) following shall be added as clause (vi):

(v1) In case of plots abutting to the road existing all around KBR park there
would be no height restriction subject to conforming to abutting road width
requirement and all round open spaces prescribed for High Rise Buildings
and subject to handing over required land for road widening ! SRDP project
of GIIMC.

AMENDMENT -6

In Rule 5, under TABLE-III in Column-3 (viz., parking provision) against Rows 1,2 & 3
(viz., plot sizes less than 50 Sqm; 50-100; 100-200) following shall be added namely:

'Stilt floor'

AMENDMENT - 7

In Rule 5, in sub rule (c) after the words "shall not be less than 4.5 m" following shall be
added namely:

'Stilt floor shall be exclusively utilized for parking purpose only and In case
of any violation or construction In the parking area the local authority shall
summarily demolish the constructions made in the parking area and
impose maximum penalties as per law'.

AMENDMENT -8

In Rule?, the sub rule (viii) shall be substituted with the following namely:

(viii) In addition to the above a minimum of 2m wide green planting strip In the
periphery on all sides within the setbacks where the setback is 9m and
above has to be developed and maintained.

AMENDMENT -9

In Rule 7, after sub rule (xv) the following shall be added namely:

(xvi) Where parting floors are provided above ground floor, the height of the
parking floors shall be excluded while reckoning the height of the building
for the purpose of deciding the setbacks as per the Table IV.

AMENDMENT -10

In Rule 8, the sub rule 8(k) shall be substituted with the following namely:

8(k) A thorough public access road of 12m width with 2 lane black-topped Is to
be developed within the applicant's site on any one side at the periphery!
as per suitability and feasibility for the convenience of accessibility of
other sites and lands located In the interior. This condition would not
apply if there is an existing abutting peripheral road on any side.
Concessions applicable to road widening cases i.e., grant of TDR / setback
relaxations I additional floors shall be considered by the Competent
Authority ( Sanctioning Authority in lieu of providing the above said road.

AMENDMENT - 11

In Rule 8, the sub rule 8(n) shall be substituted with the following namely:

8(n) 10% of the site area earmarked for organized open space Shall be handed
over to local body at free of cost through a registered gift deed before
issue of occupancy certificate and same shall be utilized as such by the
respective resident society! association only. For this purpose the society
I association may enter into an agreement with the local authority for
utilizing, managing and maintaining the open spaces.

AMENDMENT • 12

The Rule 11 shall be substituted with the following namely:

11. PAYMENT OF SHELTER FEE:

I) In case of Group Housing / Group Development Schemes whose land


extent is more than 3000 Sq.mtrs, shelter fee shall be collected as given
below. This facility will be applicable to ongoing projects also, if the
developer / builder opts for it :

ii) The shelter fee shall be collected on 20% of total site area of the project.

The shelter fee so collected shall be utilized for construction of EWS


housing under Urban Housing Scheme meant for EWS categories (2 bed
room houses) for which a separate account shall be maintained by the
local body! Hyderabad Metropolitan Development Authority I UDAs.

AMENDMENT - 13

In Rule 12, the sub rule (a) shall be substituted with the following namely:

(a) 'U' type commercial buildings with central courtyard are allowed with a
minimum plot area of 1000 Sqm with the following conditions:

AMENDMENT -14

In Rule 14, after sub rule (g) following shall be added namely:

14-A Encouragement for amalgamation of plots in old city / congested areas /


slums.

To encourage amalgamation of plots in old city / congested areas / slums, the


following incentives would be considered by the Competent Authority subject to
condition that the maximum plot size before amalgamation shall be 100 Sqm and
minimum plot size after amalgamation shall be 300 Sqm.

One additional floor or TOR equivalent to one additional floor

and

75% discount in building permit fee in slums and 50% discount in


congested fold city areas.

AMENDMENT - 15

In Rule 15, the sub rule 15(x) shall be substituted with the following namely:

15(x) In case of Group Housing Buildings where there are 100 units and above,
upto 3% of the total built up area (or) 50,000 Sft. whichever is lower shall be

planned and developed for common amenities and facilities like convenient
shopping, committee hall/ club house, creche, gymnasium etc, as per
National Building code of India (NBC) —2005. Amenities block shall not be
part of the residential blocks. However in case of single apartment block,
amenities can be provided in the same block.

AMENDMENT -16

In Rule 16, the sub rule (e) is deleted and the sub rules (b) and (0 shall be substituted
with the following namely:

(b) Upon surrendering such affected area the owner of the site would be entitled
to a Transferable Development Right (TDR) as given in Rule-17.

OR

The owner shall be allowed to construct additional floors with an equivalent


built-up area for the area surrendered subject to mandated public safety
requirements.

OR

The owner shalt be allowed to avail concessions in setbacks including the


front set-back (subject to ensuring a building line of 6 m In respect of roads
30m and above; 3m in respect of roads 18m and below 30m and 2m in
respect of roads less than 18m and subject to ensuring minimum side and
rear setback of 2m in case of buildings of height up to 12m and 2.5m in case
of buildings of height above 12m and upto 15m and 3m for buildings of height
above 15m and up to 18m).

In case of High Rise Buildings the concessions in all round setbacks would
be considered subject to maintaining minimum clear setback of 7m on all
sides and such minimum setback area shall be clear without any
obstructions, except 2 mts wide green planting strip (where the setback Is 9
m and above), which shall be soft green planting, to facilitate movement or
fire fighting vehicles and effective fire fighting operation

OR

Adjustment of land value towards building permit fee and charges (only in
cases where road widening is in progress).

OR

Adjustment of city level infrastructure impact fee towards value of the land
surrendered for formation of new Master Plan roads / link roads.

OR

Combination of above.

(f)The above concessions shall be considered at the level of Sanctioning Authority /


Competent Authority i.e.. ULB I UDA level as the case may be.

AMENDMENT -17

In Rule 17, the sub rule 11(b)(i) shall be substituted with the following namely:

17(b)(i) For the Master Plan road / Road Development Plan undertaken and
developed/ peripheral road provided in Group Development
schemes: equivalent to 250% of built up area of such area surrendered.
For conservation and development of lakes/ water bodies/ Nabs
foreshores & Recreational buffer development with greenery, etc:

equivalent to 100% of built up area of such recreational buffer area


developed at his cost.

In Rule 19, the sub rule 19(d) shall be substituted with the following namely:

19(d) The permission is valid for 6 years for all buildings, i.e., Non High Rise
buildings / High Rise buildings / Group Development schemes subject to
the condition that the construction shall be commenced within 18 months.
The permission can be revalidated for another 2 years on payment of
building permit fee. This facility will be applicable to the permissions
already given In the past.

AMENDMENT -19

In Rule 21, the Table-VI shall be substituted with the following table:

AMENDMENT -20

In Rule 23, after the sub rule (b) following shall be added namely7

(c) Compliance of public safety measures:

01 The Competent Authority while issuing building permission shall make It


binding on the developer / builder for compulsory implementation of public
safety measures as stipulated in AP Public Safety (Measures)
enforcement Act. 2013 & Rules 2014.

(ii) The Competent Authority shall, at the time of issue of Occupancy


Certificate ensure that the developer / builder has implemented the public
safety measures without any violation, as stipulated in AP Public Safety
(Measures) enforcement Act, 2013 & Rules 2014.

AMENDMENT - 21

In Rule 26, in the sub rule (c) after the words "the responsibility shall be fixed with the
concerned officer who fails to process the file" following shall be added namely:

and for every one day of delay a penalty of Rs.500/. shall be levied
on the concerned staff for delay'.

All existing rules. regulations. byelaws, orders that are in conflict or inconsistent
with the above amendments shall stand modified to the extent of the provisions of these
amendments.

In the circumstances reported by the Director General, Telangana State


Disaster Response & Fire Services, Hyderabad in the letter 2"° read above,
Government after careful examination hereby order that all the Telangana
Government buildings are exempted from the payment of Fire Precaution fees
Rs.10/- per sq. mtrs as per Section 15(1)(c) of Telangana Fire & Emergency
Operations and Levy of Fee RUles, 2006 issued vide G.O.Ms.No.306. Home
(PHA) Department, dt.7-12-2006 since the Fire Precaution fees in the form of
Challan / online is being remitted to Telangana Government Account only by
one Telangana Government Department to another Telangana Government
Department.
Necessary amendments to the Telangana Fire & Emergency
Operations and Levy of Fee Rules, 2006 will be issued separately.
The Director General, Telangara State Disaster Response 8. Fire
Services, Hyderabad shall take necesaary action accordingly.

After the formation of State of Telangana, to encourage the real estate sector to
provide employment and economic growth Government have issued certain
amendments to Building Rules vide GOs 2nd read above.

And whereas, in the context of 'Ease of Doing Business' when the existing
Building Rules were reviewed it has been observed by the Government that while
amending the Rule 7 of Building Rules in G.O.Ms.No.7 MA&UD dt:05.01.2016 under
the heading Amendment - 9 by errorenously it was written as 'ground floor' instead of
'ground level'. Therefore, to facilitate 'Ease of Doing Business' Government hereby
issue the following errata to G.O.Ms.No.7 MA&UD, dt:05.01.2016.

Whereas, by virtue of Section 101 of the Andhra Pradesh
Re-organization Act, 2014 (Central Act No.6 of 2014), the State of
Telangana is empowered by order, to make such adaptations and
modifications of any law made before 02-06-2014, whether by way of
repeal or amendment as may be necessary or expedient, for the
purpose of facilitating the application of such law in the State of
Telangana before expiration of two years from 02-06-2014, and
thereupon every such law shall have effect subject to the adaptations
and modifications so made until altered, repealed or amended by a
competent Legislature or other competent authority;
2. And whereas, it has become necessary to adapt the Andhra Pradesh
Fire Service Act, 1999 (Act No.15 of 1999) for the purpose of facilitating
its application in relation to the State of Telangana;
Now, therefore, after careful examination, Government have
decided to adapt "the Andhra Pradesh Fire Service Act, 1999" (Act
No.15 of 1999), which are in force as on 01.06.2014 with modifications
as required,
Accordingly, the following Notification will be published in an
Extraordinary Issue of the Telangana State Gazette, dated:20.11.2015.

NOTIFICATION
In exercise of the powers conferred by section 101 of the Andhra
Pradesh Re-organization Act, 2014 (Central Act No.6 of 2014), the
Governor of Telangana hereby makes the following order, namely:-
(1) This order may be called "The Andhra Pradesh Fire Service
Act, 1999" (Telangana Adaptation Order) 2015,
(2) It shall be deemed to have come into force with effect from
02.06.2014
The Andhra Pradesh General Clauses Act, 1891 shall apply for
the interpretation of this order as it applies for the
interpretation of a State Act.

For the purpose of this Order and the Act adapted herein, the
expression "the State" shall have the meaning and area as
specified in section 3 of the Andhra Pradesh Reorganization Act,
2014.

Throughout the Act, for the words "Andhra Pradesh" occurring


otherwise than in a citation or description or title of other
enactments, the word "Telangana" shall be substituted;

5. In section 13 for sub-section (2) the following shall be
substituted, namely;
" (2) The Director General or any member of the service
duly authorised by him in this behalf, shall within sixty days of
receipt of such application or on inspection being satisfied
about the provision of Fire Prevention and Safety measures as
stipulated in the National Building Code of India, as amended
from time to time, and for ensuring heights and setbacks as per
the Hyderabad Municipal Corporation Act, 1955, Telangana urban
Areas (Development) Act, 1975 , Hyderabad Metropolitan
Development Authority (HMDA) Act, 2008, Telangana Municipal
Corporations Act, 1994, Telangana Municipalities Act, 1965,
Andhra Pradesh Town Planning Act, 1920 and Rules, made there
under as amended from time to time shall issue a no objection
certificates with such conditions as may be considered necessary
and if not so satisfied, reject the same for reasons to be recorded
in writing."

Whereas, by virtue of section 3 of the Andhra Pradesh
Re-organization Act, 2014 (Central Act No.6 of 2014), the State of
Telangana comprising the territories specified therein has been formed
on and from the appointed day i.e., 02.06.2014.

And whereas, In section 101 of the Andhra Pradesh


Reorganization Act, 2014, a provision has been made for the purpose of
facilitating the application of any law (as defined In section 2 (f) of
the Act), made before the appointed day, in relation to the State of
Andhra Pradesh or the State of Telangana, the appropriate Government
may before expiration of two years from 02.06.2014, by order, make
such adaptations and modifications of the law, whether by way of
repeal or amendment, as may be necessary or expedient, and
thereupon every such law shall have effect subject to the adaptations
and modifications so made until altered, repealed or amended by
a competent Legislature or other competent authority.

And whereas, it has become necessary to adapt, with


modifications/ amendments, the Andhfa Pradesh Fire & Emergency
Operations and Levy of Fee Rules, 2006 in force as on 01.06.2014 for
the purpose of facilitating its application in relation to the State of
Telangana.

Now, therefore, after careful examination, Government have


decided to adapt the said the Andhra Pradesh Fire & Emergency
Operations and Levy of Fee Rules, 2006, which are in force as on
01.06.2014 with modifications as required.

Accordingly, the following Notification will be published In an


Extraordinary issue of the Telangana State Gazette, dated: 20.11.2015.

NOTIFICATION
In exercise of the powers conferred by section 101 of the Andhra
Pradesh Re-organization Act, 2014 (Central Act No.6 of 2014), the
Governor of Telangana hereby makes the following order, namely:-
1. (1) This order may be called "The Andhra Pradesh Fire &
Emergency Operations and Levy of Fee Rules, 2006
(Telangana Adaptation Order) 2015."
(2) It shall be deemed to have come into force with effect from
02.06.2014.

For the purpose of this order and the rules adapted herein,
the expression the State" shall have the meaning and areas
specified In section 3 of the Andhra Pradesh Reorganization
Act, 2014.
In the A.P.Fire & Emergency Operations and Levy of fee Rules,
2006 throughout the Rules, for the expression "Andhra
Pradesh" occurring otherwise than in a citation or description
or title of other enactments, the word "Telangana" shall be
substituted;
In the said Rules, the Rule-15(1) (d) is deleted.

In the G.0.1" read above, Government had accorded permission to the
Director General, A.P. State Disaster Response & Fire Services Department to
collect User charges for under taking inspections of Multi Storeyed Buildings and
Hazardous premises towards the issuance of No Objection Certificate and other
Fire Safety Measures..
The Director General, Telangana State Disaster Response & Fire
Services, Hyderabad in the lettpr 2nd read above, has stated that, in the G.O. first
read above, there is no provision to collect User Charges for conducting the Fire
Audit in the Multi Storeyed Buildings for issuance of No Objection Certificate from
Fire Service Department and requested for inclusion of the two items in the said
G.O.
Government after careful examination, hereby issue the following
amendment to the orders issued in the G.O.Ms.No.71 Home (PrisonsA)
Department, dt.01-04-2010:-

In the para-6 of G.O.Ms.No.7, Home (PrisonsA) Department, dated
01-04-2010, after SI.No.7, re following Items shall be added:

ORDER:

In the orders read above, Government have amended the Telangana


Municipalities Act, 1965; the Greater Hyderabad Municipal Corporation Act, 1955; the
Telangana Urban Areas (Development) Act, 1975; Hyderabad Metropolitan
Development Authority Act 2008 duly authorizing the Municipal Commissioners /
Metropolitan Commissioner of Hyderabad Metropolitan Development Authority / Vice
chairmen of Urban Development Authorities (in case of Gram Panchayats falling under
Urban Development Authorities) to regularise the unauthorized constructions /
deviations as a one-time measure. Consequently Government hereby issue the
Telangana Regularization of Unauthorizedly constructed buildings and buildings
constructed in deviation of the sanctioned plan Rules 2016,

2. Accordingly the following Notification shall be published in the Extraordinary


Gazelle of Telangana Dated: 3.11.2015

NOTIFICATION

In exercise of the powers conferred in Section 216(A) of the Te/angana


Municipalities Act, 1965, Section 455M of the Greater Hyderabad Municipal
Corporation Act, 1955, Section 46(A) of the Telangana Urban Areas (Development)
Act, 1975, Section 23(A) of the Hyderabad Metropolitan Development Authority Act
2008 the Government of Telangana hereby makes the following Rules, namely

1. Short Title, Application and Commencement:

These Rules may be called "Telangana Regularization of unauthorizedly


constructed buildings and buildings constructed in deviation of the
sanctioned plan Rules, 2015"

They shall be applicable to existing buildings in the jurisdiction of all


Municipal Corporations, Municipalities, Hyderabad Metropolitan
Development Authority and Urban Development Authorities in the State of
Telangana constructed from 01.01.1985 to 28.10.2015.

They shall come into force from the date of publication of the Notification
in the Telangana Gazette.

2. Definitions:

(1) "Licensed technical personnel" means professionals authorized by the


Competent Authority to take up scrutiny of the Application made for
regularization under these Rules.
'Competent Authority" means the Municipal Commissioner in case of
areas falling in the Municipal Corporation and Municipal limits, the
Metropolitan Commissioner. Hyderabad Metropolitan Development
Authority / the Vice Chairman of the Urban Development Authority in case
of areas falling outside Municipal Corporation or Municipality in the
Hyderabad Metropolitan Development Authority / Urban Development
Authority area

"Total Built up area means the entire built up area covered in the building
including common areas and balconies on all floors.

"Unauthorized construction means any building that has been constructed


in deviation of the sanctioned building plan or without obtaining a building
permission from the sanctioning authority.

Compulsory Application for Regularization :

An Application for regularization of existing unauthorizedly constructed buildings


shall be compulsorily made by the owner/CPA/Registered Association to the
Competent Authority or officer authorized by him in the prescribed Proforma
along with Declaration, Self Assessment, copy of sanctioned building plan, if any,
a clear latest photograph of the building, copy of document of Ownership title,
Indemnity Bond and two sets of drawings showing the sanctioned area and
violated area of the building/Complex and In case of totally unauthorized
constructions the total built up area along with the site plan. 11 shall be filed within
sixty days from the date of Notification of these rules along with 50% of
regularization amount as given in Rule 5 or minimum Rs 10,000/- whichever is
less. If any owner/individual does not apply within the stipulated time, he shall be
liable for enforcement action under the law and his building shall not be taken up
for regularization under these Rules.

Prior clearance from other Authorities/Departments:

In respect of cases of residential buildings 18 m and above in height,


Commercial buildings 15mts. and above in height, and buildings of public
congregation like schools. Cinema theatres, function halls and other
assembly buildings on plot area of 500 sq. mts. and above or of height
above 6mts as stipulated in Section 13 of the Andhra Pradesh Fire
Service Act. 1999 NOC from Fire Service Department.

From Airport Authority of India wherever applicable.

Irrespective of height of the building necessary certificate from licensed


structural engineer (in case of High Rise Building)/ licensed engineer (in
case of non-High Rise Building) as the case may be with regard to
structural safety compliance of such buildings needs to be submitted.

Applicants shall submit application along with the above details within the
stipulated time. However, an additional time period of three months will be allowed for
filing the Clearances as requited under Rule 4 (a) and 4(b).

6. Payment of fees and charges:

(a) The owner/applicant shall pay the Charges as given in Annexure-I /


Annexure -II as applicable along with the Application for Regularization
and other details. The Charges are levied for the total violated built up
area on all floors. The Charges include Building permit fee, Development
Charges, Betterment charges, Impact Fees, etc. Na other fees and
charges shall be levied and collected. The actual regularization charges
will be percentage of basic regularization charges mentioned in Annexure
Ill and same shall be calculated based on the land value prevailing as on
28.10.2015.
M) The above lees and charges shall be remitted by way of Demand Draft
drawn in favour of the Competent Authority

(c) The above amounts paid are not refundable. However, in cases of
rejection, the Competent Authority may refund the amount after retaining
10% of the above amount paid by the applicant towards scrutiny and
processing charges. In case of bonafide error in calculation, the excess
amount paid may be refunded.

Scrutiny, Rejection and Approval by the Competent Authority:

After receipt of the Application for Regularization in the prescribed Format along
with required documents and plans, the Competent Authority shall scrutinize the
applications and after carrying out necessary site inspections, communicate it's
approval or rejection to the applicant as early as possible but not beyond six
months from the last date of receipt of Applications. The Competent Authority
may engage the services of licensed technical personnel for scrutiny of the
applications and for field inspections. Mere receipt of application or any delay in
communication of final orders in the matter will not imply the approval of the
application.

Violation after submission of Application:

During verification, if it is found that the applicant has undertaken further


additions or extensions to the existing building, then such application shall be
summarily rejected duly forfeiting the entire regularization amount and necessary
action shall be taken against the unauthorized building including demolition as
per the law.

Exemption:

Buildings constructed prior to 01.01.1985 are not covered under these Rules.

Regularization not to apply to certain sites:

Regularization of unauthonzed constructions shall not be considered in the


following cases and In cases where public interest and public safety are likely to
be adversely affected, viz.

Encroachment on Government land or properly belonging to Public


undertakings. Housing Board, Telangana State Industrial Infrastructure
Corporafion.trban Development Authorities, Local bodies, Endowments,
Wakf Board, etc.;

Land for which the applicant has no title;

Surplus land declared under Urban land Ceiling /Agriculture Land Ceiling/
lands resumed under Assigned Lands ( POT) Act

Buildings affected under alignment of any road or proposed road under


Master Plan2onal Development Plan/Road Development Plan or any
other public roads/MRTS;

Tank bed and Sikham lands;

(0 Areas prohibited for construction under GOMs No, 111 MA&UD Dept.,
dated 8-3-1996 (protection of Catchment area of Osmansagar and
Himayatsagar lakes);

LayouUMaster Plan open spaces/Areas earmarked for Recreation Use


/open space use in Master Plan/Zonal development Plan;

Buildings that are not in conformity with and use and zoning regulations
approved In Master Plan/Zonal development Plan;
Sdes under legal litigation/ disputes regarding ownership of the site /
building:

Area earmarked for parking as per sanctioned plan;

Unauthorized constructions without any building sanction in unapproved


/unauthorized layouts, for which prior approval ot site/plot under
regularization of unapproved and illegal layout rules shall be obtained;

However in case of Rule 9(k), applications for Regularization will be accepted if


the applicant encloses the Acknowledgment of the Application made for
regularization of the unauthorized site/plot under the relevant rules to the
competent authority.

10. Issue of Occupancy Certificate:

In case of approval, the Competent Authority shall issue proceedings to the


effect that all 'proceedings and action of enforcement Initiated or contemplated
against the said construction are withdrawn and then issue Occupancy
Certificate to the applicant.

11. Appeal:

Any applicant aggrieved by an order passed by the Competent Authority


under Rule 6, may prefer an appeal to the Committee constituted by the
Government within thirty days from the date of receipt of the order
provided the applicant has paid the necessary charges and submitted
documents as specified in Rule 3 and 5 of these rules.

All the appeals shall be disposed off within 3 months.

12. Failure to come forward for Regularization of unauthorized constructions:

VVhere an application for regularizing the unauthorizedly constructed building has


not been made as per rule 3;

Such unauthorized constructions would be treated as continuing offence


and Penalty as per law would be levied.

Other enforcement action including demolition shall be Initiated by the


local authority as per law.

No further building approvals shall be considered by the building


sanctioning authority in the said site.

13. Amount levied kept in separate account:

(a) The amount collected by the Competent Authority under these rules shall
be kept and maintained under the control of the Competent Authority in a
separate escrow account and utilized only for improvement of amenities in
the area.

(h) In respect of Gram Panchayat areas falling in the Hyderabad Metropolitan


Development Authority/Urban Development Authority areas, the
regularisation amount so collected will be shared In equal proportion
between the Development Authority and Gram Panchayal concerned. In
respect of Municipal Corporations and Municipalities falling In Hyderabad
Metropolitan Development Authority / Urban Development Authonty areas,
the regularisation amount will be shared between the concerned Municipal
Corporadon/Municipality and Metropolitan Development Authority / Urban
Development Authority in the ratio of 70 : 30.
Constitution of Committee:

Government will issue separate orders constituting appellate Committees for


examining appeals under rule 11.

Government may issue guidelines to operationalize these rules.

IS. All existing rules, regulations, bye-laws and orders that are in conflict or
inconsistent with these rules shall stand modified to the extent of the provisions
of these rules.

defect/litigations/Land Acquisition over the said site/land and the same shall be free
from all claims of Govt./Banks/and attachments of Courts, and the FIRST PARTY has to
indemnify the SECOND PARTY to this effect.

Whereas the FIRST PARTY having agreed to the aforesaid condition hereby
indemnifies the SECOND PARTY with the above assurance and hereby solemnly
declare that the above said site/land is the property of the FIRST PARTY which Is
possessed by him/her since the date of purchase and the same is free from all defects,
litigations, claims and attachments from any courts, etc. and In case of any
disputes/litigations arises at any time in future the FIRST PARTY will be responsible for
the settlement of the same and the SECOND PARTY will not be a party to nay such
disputes/litigations.

ORDER'

In the reference Zvi read above, MIS Wonderla Holidays Ltd. has
submitted proposal for approval of the project of Sky wheel Tower at
Kongarakhurd A Village, Maheswaram Mandel, R.R. District, with a total
height of 77 mtrs. from the ground with fire permission.

The Director General, Telangana State Disaster Response & Fire


Services, Hyderabad has examined the proposal and reported that, according
to G.O.Ms.No.168, Municipal Administration & Urban Development (M1)
Department, Dated:04.07.2012 there is no provision for Issuance of No
Objection Certificate for this type of special building/structure (Assembly
Occupancy) with a height of 80 Mtrs. As per Table 23 of National Building
Code, 2005, the buildings above 30.00 meters height for Assembly
Occupancy are pot permissible and Fire Safety measures for
buildings/structures above 30 Mtrs height are not prescribed and therefore
proposed for making suitable amendments to G.O.Ms.No.168, Municipal
Administration S. Urban Development (M1) Department, Dated:04.07.2012
for permitting special structures like Sky Tower Buildings as proposed by M/s.
Wonderla. He has also suggested to constitute an expert Committee for
suggesting the required Fire Safety Measures for Assembly Buildings/ Special
Structures above 30 meters height as the same are not available either in the
part 4 of National Building Code of India, 2005 or G.O.Ms.No.168, Municipal
Administration & Urban Development (M1) Department, Dated:04.07.2012.

As per the provisions of Building Rules Issued In G.O.Ms.No.168,


Municipal Administration & Urban Development (M1) Department,
Dated:07.4.2012, there is no height restriction on any building activity
(Including Assembly Buildings) except in Banjara Hills and Jubilee Hills areas
and maximum height permissible on a given plot is based on plot area, road
width and subject to compliance of recent Color Coding given by the Civil
Aviation Department and depending on the height of the building and also
prior No Objection Certificate from Fire Services Department. Hence, the
following Committee Expert Committee has been constituted to
suggest/recommendations on the subject matter:

4. The Expert Committee have examined the Life and Fire Safety Issues In
Educational, Assembly, Mercantile Buildings and Special Structures like
Amusement Parks, Joy Rides etc., above 30 meters height and the existing
provisions of part 4 NBC of India 2005 and submitted its report
recommending certain additional Fire Safety measures in addition to the
existing measures, for issuance of No Objection Certificate by the Fire
Services Department for the buildings/structures for 30 Mtrs. above height,
to ensure Life and Fire Safety of the occupants of these Buildings.

Services, Hyderabad in his letter 5 read above has requested to include the
recommendations of the Expert Committee in the Telangana Are and
Emergency Operations and Levy of Fee Rules, 2006 In supersession of the
Government orders issued for Cinema Theatres/Multiplexes vide
G.O.Ms.No.135, Home (General) Dept., Dated:03.06.2006, G.O.Ms.No.306,
Home (Prlsons.A) Dept., Dated:07.12.2006 and G.O.Ms.No.177, Home
(General.A) Dept., Dated:03.07.2013, for issuance of No Objection Certificate
by Fire Service Department for Educational / Assembly / Mercantile Buildings
and Special Structures above 30 meters and below 45 meters height.

Government after careful examination of the entire matter and the


recommendations of the Expert Committee on the issue of No Objection
Certificate for Fire Safety Measures for the buildings 30 meters & above upto
45 Meters height by the Fire Service Department, in respect of (I) Existing
Educational Buildings (Other than Schools), (ii) New Educational Buildings
(Other than Schools), (ill) Existing Assembly Buildings, (Iv) New Assembly
Buildings, (v) Existing Mercantile Buildings, (vi) New Mercantile Buildings,
(vii) New Assembly Group and (viii) New Occupancy: Open Structures without
any height restriction along with additional safety measures suggested
therein, hereby approve the same and decided to issue amendments to
Telangana Fire and Emergency Operations and Levy of Fee Rules, 2006.

Accordingly, the following notification will be published in the Telangana


Gazette:

NOTIFICATION

In exercise of the powers conferred by Section 47 (2) (k) of the


Telangana Fire Service Act, 1999, the Governor of Telangana hereby makes
the following amendments, In supercession of orders issued in
G.O.Ms.No.177, Home (General. A) Department, Dated:03.07.2013, to the
Telangana Fire and Emergency Operations and Levy of Fee Rules, 2006
issued in G.O.Ms.No.306, Home (Prisons.A) Department, Dated:07.12.2006
and as amended from time to time.

AMENDMENT
In the said rules:
(i) In rule 15, after sub rule 6, the following sub rules shall be added
namely:-

"(7) Additional Fire Safety measures for the Educational, Assembly,


Mercantile Buildings and Special Structures viz., amusement parks, joy
rides etc., above 30 meters height and upto 45 meters height shall be
as prescribed in the Annexure.

(6) User charges for high-rise building above 30 metres in height and
upto 45 metres height at the rate of Rs. 100/- per square metre for
entire built-up area including the existing built-up area shall be
payable in addition to .the Fire Precaution fee payable as per Rule
15(C) the Rule."

Refuge area: For Buildings more than 30 mtrs in height, refuge area
of 15 m2 or an area Equivalent to 0.3 m2 per person to accommodate
the occupants of each floor shall be provided at every floor of above
30 meters height as per Clause 4.12.3 of Part 4 NBC of India,2005.

Fire Tower: As per clause 4.13 of Part 4 , NBC of India 2005, one
of the staircases shall be provided as Fire Tower for buildings above
30 mtrs height.
A qualified Fire Officer with experience of not less than 3 years shall
be appointed who will be available on premises and who shall
discharge the duties as per clause C-6.2 of Annexure C of Part 4,
National building code of India 2005.
All Fire and Life safety measures prescribed in the National Building
Code of India Part 4 of 2005 shall be complied with including the
Exits, Doorways, Stairways, External Stairways, Ramps according to
Table 20 (Clause 4.3), Table 21(Clauses 4.4.2, 4.4.3 and C-1.6.2)
and additional fire safety requirements of High rise buildings as per
Annexure C of Part 4, National building code of India 2005 as
amended from time to time.

Mats:
Structural Stability/Integrity of the existing buildings proposing to
increase the height beyond 30 metres has to be dealt by the
GHMC/FIMDA/Local bodies.
In such occupancies, where there are Hon'ble Supreme Court Orders
are there regarding Fire and Life safety, Fire and Life safety
measures prescribed in the part 4, National Building Code of India
2005 updated from time to time shall prevail over the Local laws

shall be appointed who will be available on premises who shall
discharge the duties as per C-6.2 of Annexure C of Part 4,
National building code of India of 2005.
All Fire and Life safety measures prescribed in the Part-4,
National Building Code of India 2005 shall be complied with
including the Exits, Doorways, Stairways, External Stairways,
Ramps according to Table 20 (Clause 4.3), Table 21(Clauses
4.4.2, 4.4.3 and C-1.6.2) and additional fire safety
requirements of High rise buildings as per Annexure C of Part
4, National building code of India of 2005.
Note:
Structural Stability/Integrity of the existing buildings
proposing to increase the height beyond 30 metres has to be
dealt by the GHMC/HMDA/Local bodies.
In such occupancies, where there are Hon'ble Supreme Court
