FACTS:
Conchita Agliday, the appellant’s wife, testified that at about 8:00 in the evening of February 25,
1999 her son, Richard Agliday, her son, was shot by her husband-appellant, Ricardo Agliday,
and fell belly-first on the ground. As the appellant ran away, she was able to call for help.
Richard was brought to the Sto. Niño Hospital, then to the San Carlos General Hospital, and
finally to the Region I Hospital in Dagupan City. Before the shooting, the couple had a fight over
Conchita’s work. Rey Agliday, another son of the appellant, testified and recounted that Richard,
did interfere. He then saw his father-appellant shoot his brother with a shotgun.
Appellant, Ricardo Agliday, is a barangay tanod of Nalsian Sur, Bayambang, Pangasinan. He
attested that sometime on February 25, 1999 at about 8:00 in the evening, as he was cleaning a
homemade shotgun that he intends to bring in the night patrol together with his fellow tanods,
the homemade shotgun accidentally went off and hit Richard’s buttocks. He went near his son
and embraced him, then, brought him to the Sto. Niño Hospital, then to San Carlos General
Hospital, and finally to the Region I Hospital in Dagupan City where Richard eventually died.
Appellant surrendered himself to the barangay captain. Jose Matabang, Jr. and the barangay
captain brought the appellant to the police authorities.

ISSUE:
Whether or not Agliday is guilty of Parricide.

HELD:
The appellant, Ricardo Agliday, was found guilty of parricide. The court faced two conflicting
versions of facts yet they gave credence to the testimonies given by the two witnesses for it was
straightforward and sincere. The court believed they have no reason to falsely testify against him,
given the relationship they have. They viewed the appellant’s testimony as a desperate attempt to
exculpate himself from the consequences of his crime.
