ABSTRACT

The given topic of this project as Anglo-mohammadan law : with full reference to modern
and ancient authorities deals with giving detail analysis on every sector of this law and their
application during colonial rule. Due to its triple nature—Muslim personal law, Common
Law influence, and affiliation with the larger Indian legal system—the Anglo-Muhammadan
Law stands out in the current comparative legal landscape. Even Nevertheless, it represents a
subject of study that is routinely disregarded despite its peculiarity. The current essay makes
an effort to clarify it, at least in part. First, the essay presents a historical outline of the
evolution of Anglo-Muslim law, highlighting the key British inventions and changes and
their inevitable legal, social, and religious repercussions then shows its connection with the
current rules.

This project, however, illustrates, in addition, that, despite a powerful drive towards
uniformity fostered by the prevailing system, the AngloMuhammadan Law preserves the
distinctive features of the community it governs, for identity reason. Hence, the peculiar
outcomes of the evolution of this branch of law could serve as a model to other national
legislators facing similar issues within multicultural and multiethnic contexts.

The Anglo-Muhammadan Law, a corpus of laws based on Islamic Law but modified by
British jurists, was initially applied to Indian Muslims in colonial courts and which, despite
India's independence from colonial rule, is still in effect today.

The need to adapt it to the historical and social development of the country, it is still in effect
today, albeit with certain modifications. After a brief introduction to the topic, the project's
first section focuses on Islam, its legal principles and sources of law, which is a necessary
presumption to understand the scope of the Anglo-Muslim Law; the second section then
describes the law's historical development, giving the British administrators' point of view, as
well as its fundamentals and foundations and tries to give full reference to its connection with
the modern and ancient authorities.
