NOTICE

Sirs/Mesdames :
Please take notice that the Court en banc issued a Resolution dated
DECEMBER 6, 2022, which reads as follows:
"G.R. No. 264223 (United Church of Christ in the Philippines Pastors
Rev. Edwin R. Egar and Rev. Julieta R. Egar; and Brgy. Macalamcam-a Former
Barangay Captain Ronald Malabanan Ramos vs. Armed Forces of the
Philippines Chief of Staff, Lt. Gen. Bartolome Vicente Bacarro; Philippine
Army Commanding General, Lt. Gen. Romeo S. Brawner, Jr.; Commanding
Officer of the 2nd Infantry Division of the Philippine Army, Maj. Gen. Roberto
S. Capulong; 59th Infantry 'Protector' Battalion Commander, Lt. Col. Ernesto
R. Teneza, Jr.; Sgt. Ronald Dalo, Sgt. John Granpil, Pfc. Borge Ebol, Roy Dela
Peña, 'Bong' Samela, Lt. Taro, and John Does and Jane Does Who are Officers
or Enlisted Personnel Belonging to the 59th Infantry 'Protector' Battalion). —
Acting on the Petition for the Writ of Amparo, the Court Resolved to:
(1) ISSUE the WRIT OF AMPARO (Writ), returnable to the
Supreme Court of the Philippines;
(2) ORDER respondents Lt. Gen. Bartolome Vicente Bacarro, in his
capacity as Chief of Staff of the Armed Forces of the Philippines;
Lt. Gen. Romeo S. Brawner, Jr., in his capacity as Commanding
General of the Philippine Army; Maj. Gen. Roberto S. Capulong, in
his capacity as Commanding Officer of the 2nd Infantry Division
of the Philippine Army; Lt. Col. Ernesto R. Teneza, Jr., in his

capacity as Commander of the 59th Infantry 'Protector' Battalion;
Sgt. Ronald Dalo, Sgt. John Granpil, PFC. Borge Ebol, Roy Dela
Peña, 'Bong' Samela, Lt. Taro, and John Does and Jane Does, in
their capacities as Officers or Enlisted Personnel of the 59th
Infantry 'Protector' Battalion, to make a verified RETURN of
the Writ of Amparo before the Supreme Court within twenty (20)
days after its service, together with this Resolution, and to
COMMENT on the Petition within the same period. The RETURN,
together with supporting affidavits, shall, among other things,
contain the following:
(a) The lawful defenses to show that respondents did not
violate or threaten with violation the right to life, liberty and
security of petitioners, through any act or omission;
(b) The steps or actions taken by respondents to determine
the fate or whereabouts of petitioners and the person or
persons responsible for the threat, act, or omission; and
(c) All relevant information in the possession of respondents
pertaining to the threat, act, or omission against petitioners.
(3) GRANT the TEMPORARY PROTECTION ORDER, prohibiting
respondents from going within a radius of one (1) kilometer of
petitioners and their immediate families.
Let a copy of the Writ and this Resolution be served upon the parties
by personal service." (adv37)
