6709 STATUTORY INSTRUMENTS 1974 No. 1944 BUILDING AND BUILDINGS ‘The Building (Second Amendment) Regulations 1974 Made- - - 22nd November 1974 Laid before Parliament 9th December 1974 Coming into Operation Bist January 1975 ‘The Secretary of State for the Environment, in exercise of the powers conferred by sections 61 and 62 of the Public Health Act 1936(a), as amended by section 11 of and Part II] of Schedule I to the Public Health Act 1961(b), and section 4 of the Public Health Act 1961 and now vested in him (e) and of all other powers enabling him in that behalf, after consultation with the Building Regulations ‘Advisory Committee and such other bodies as appear to him to be representative Of the interests concerned, as required by section 9(3) of the Public Health Act 1961, hereby makes the following regulations:— Title and commencement 1, These regulations may be cited as the Building (Second Amendment) Regulations 1974 and shall come into operation on 31st January 1975. Interpretation 2.—(1) In these regulations, unless the context otherwise requires— (@) “the principal regulations” means the Building Regulations 1972(@) as ‘amended by the Building (First Amendment) Regulations 1973(e), and other words and expressions have the same meaning as in the principal regulations; and (®) any reference to a Part, regulation or schedule shall be construed as a reference to a Part or regulation of, or schedule to, the principal regula~ tions. (2) The Interpretation Act 1889(f) shall apply for the interpretation of these regulations as it applies for the interpretation of an Act of Parliament. Transitional provisions 3.—(1) These regulations shall not apply to any work which was completed before the date of the coming into operation of these regulations. (2) These regulations, except regulation 9, shall not apply to any work which ‘was completed after that date in accordance with plans deposited with the local authority before that date, with or without any departure or deviation from those plans. (3) For the purposes of this regulation “work” means the erection of a build- ing, the alteration or extension of a building, the execution of works, the installation of a fitting or the making of a material change of use. a) 1936 6 49 (© SL 1970/1681 (1970 11, p, 5551). {© SU. 1973/1296 1973 1, p. 3839) e110 BUILDING AND BUILDINGS Amendment of the principal regulations 4. The principal regulations shall be amended as provided in these regulations. 5, For regulation DS (Deemed-to-satisfy provision for reinforced concrete foundations) there shall be substituted the following regulation: “Deemed:-to-satisfy provisions for reinforced conerete foundations DS.—{1) Subject t0 the provisions of paragraph (2), if the foundations of «building are constructed wholly or in part of reinforced concrete, the require- ‘ments of regulation D3(a) shall be deemed to be satisfied, in so far as those parts of the foundations constructed of reinforced concrete are concerned, ifthe work com plies with either— (@) CP 110: Part 1: 1972 (as read with CP 110: Part 2: 1972 and CP 1101 Part 3: 1972): or (0) CP 114: Part 2: 1969. 2) The recommendations of the publications specified in paragraph (1\(a) shall not be used in conjunction with those of the publication specified in para- graph (1)0).". 6. For regulations D1! (Deemed-to-satisfy provision for structural work of reinforced concrete), DI2 (Deemed-to-satisfy provision for structural work of prestressed concrete) and D13 (Deemed-to-satisfy provision for structural Work of precast concrete) there shall be substituted the following regulation: “Deemed-to-satisfy provisions for structural work of reinforced, prestressed or plain concrete, DIL.—(1) Subject to the provisions of paragraph (2), the requirements of regulation D8 shall be deemed to be satisfied as to any structural work (whether ‘ast inst oF precast) of reinforced, prestressed or plain conerete ifthe work complies (a) CP1I0: Part 1: 1972 (as read with CP 110: Part 2: 1972 and CP110: Part 3: 1972); or (6) in the case of work of reinforced, prestressed or precast concrete, CPLI4: Part 2: 1969, CP 115: Part 2: 1969 or CPI16: Part 2: 1969 (as read with CPI16:"Addendom No, 1: 1970) whichever is appropriate. (2) The recommendations of the publications specified in paragraph (Xa) shall not be used in conjunction with those of any publication specified in para- graph (0)."- 7, For regulation D14 (Deemed-to-stisty provisions for structural work of timber) there shall be substituted the following regulation: ““Deemed-to-satisfy provisions for structural work of timber D1. The requirements of regulation DS shall be deemed to be satisfied as fo any strucrual work of timber if— (@) the work complies with CP112: Part 2: 1971; or (6) in the case of work which— @ consists of a floor, ceiling or roof of a house which has not more thay he ators ond i end be oct yon fay ony: (i) includes any timber member within the meaning of Schedule 6, that member complies with the rules contained in that schedule and the work in all other respects complies with CPII2: Part 2: 1971; or (0 in the case of work which consists of a roof of trussed rafter construc tion, the work complies with CP112: Part 3: 1973.". s. 974/194 67 8, For regulation D21 (Deemed-to-satisfy provi ising large precast concrete panels) there shall be substituted the following regulation: *Deemed-to-satisfy provisions for the structure of certain buildings constructed of reinforced, prestressed or plain concrete D2U.—(1) Subject to the provisions of paragraphs (2) and (3) if the structure of a building consists of work (whether east in-situ or precast) of reinforced, prestressed or plain concrete, the provisions of regulation D19 shall be deemed to be satisfied if— (@) the work complies with the recommendations relating to the effect of ‘misuse or accident in Section 2 of CPIIO: Part 1: 1972 and with all relevant recommendations relating. 10 the provision of ties in that publication; or (©) in the case of work of reinforced, prestressed or precast concrete, ‘the work complies with the recommendations relating to the effect of misuse or accident in clause 301 of CPII4: Part 2: 1968, CPIIS: Part 2: 1969 or CPLI6: Part 2: 1969 (as read with CP1I6: Addendum No. 1: 41970) whichever is appropriate and with all relevant recommendations relating to the provision of tes in that publication, 2) The recommendations of the publication specified in paragraph (Ia) sil owed in conjunction with th of ypbind i para ‘graph (6). (3) If for the purposes of regulation DI1, reliance is placed on any one of the publications referred to in paragraph (1) of this regulation, then reliance may be laced only on that publication for the purposes of this regulation. (4) For the purposes of CPLI6: Part 2: 1969 and CP1I6: Addendum No. 1 1970 the building shall be classified as a Group I structure. 9. Afer regulation D21_as substituted by regulation 8 of these regulations there shall be inserted the following regulation: “Use of high alumina cement for structural work 1D22.—Regulation B2 and the deemed-to-satisy provisions in this Part shall not apply in relation to structural work, including foundations, in which high alumina cement is used.”. 10. In regulation ES (Fire resistance of elements of structure) as substituted by the Building (First Amendment) Regulations 1973, there shall be substituted for the proviso to paragraph (4)(b)(i) the following proviso: “Provided that any beam or column (whether or not it forms part of a structural frame) which is within or forms part ofa wall, and any column which. gives support to a wall or gallery, shall have fire resistance of not less than the minimum period, if any, requited by these regulations for that wall or that gallery;". 11, There shall be substituted for Part F (Thermal Insulation) the Pact set out in Schedule 1 to these regulations. ona BUILDING AND BUILDINGS 12. There shall be substituted for Schedule 6 the schedule set out in Schedule 2 to these regulations. 13, There shall be substituted for Schedule 11 the schedule set out ia Schedule 3 t0 these regulations. 14, In Schedule 13— (@),in the heading to the schedule there shall be substituted for the word “First” and the date “1973” the word “‘Second” and the date "1974"; © in Table A— (@ there shall be substituted for the entries relating to BS 881 & 589: 1955 and BS 1297: 1970 the entries set out in Schedule 4 to these regulations; and (Gi) there shall be added the entries relating to BS 4978: 1973 set out in that schedule; and (©) in Table B— (@ the entries relating to CPI12: 1952 shall be omitted; i) there shall be substituted for the entries relating to CP112: Part 2: 1971, CP114: Part 2: 1969, CP115: Part 2: 1969, CP116: Part 2: 1969’ and CP116: Addendum No. 1: 1970 the entries set out in Schedule 4 to these regulations; and (ii) there shall be added the entries relating to CPLIO: Par: 1: 1972, CP110: Part 2: 1972, CP110: Part 3: 1972 and CPII2: Part 3: 1973 set out in that schedule, Regulation 11 SCHEDULE 1 PaRr To BE stssmTUTED FoR Part F (THERMAL INSULATION) (OF THE PRINCIPAL REGULATIONS PART F ‘TeRMat. INSULATION Application of Part F |—(1) Subject to the provisions of paragraph (2), this Part shall apply to any building, or part of a building, which is intended to be used as a dwelling. (2) This Part shall not apply to any external wall, foot or roof of any part of a dwelling which consists of a shed or store entered from outside or of a gavage, boat- house, conservatory or porch, Interpretation of Part F F2—(I) In this Part and in Schedule 11— “dwelling” means a house, flat or maisonette: “partially ventilated space” means a space which— (@) is either— 0 & passage, stairway or other common space which is not part of, but adjoins, a’ dwelling; of S1.1974/1944 6713 Gi) a part of a dwelling which consists of a shed or store entered from Outside or of a garage, boathouse, conservatory or porch; and.
