CIRCUMSTANCE
Third party vehicle hit into insured vehicle from behind as both vehicles were heading in the same
direction.

This was due to misjudgment of clearance distance and speed of the insured vehicle by the third
party vehicle driver.

The said impact resulted in serious damage to the left rear end of the insured vehicle.

The driver was charged for careless driving.

RECOMMENDATION
Motor Assessor – Northern Region is of the view that insured vehicle should be written off due to the
following reasons;

 Insured does not want to keep the I/V because of some of the damages that were occasioned
to it such as damage to electrical components of the Seat Headrests which are part of safety
features in Mercedes Benz vehicles.

 Insured’s preferred repairer – Sprayrite could not issue a quotation citing challenges in
obtaining the needed parts
 Southern Cross Motors quote [K 315,049.02] renders I/V a write off
 Top Gear and Auto Guard’s quotations are questionable as they left out certain items e.g.
Head Rests
 Automagic quoted repairs to Headrest which is unacceptable as this may compromise safety
of the vehicle even after repairs are concluded.
 Top Gear Motors indicated that certain parts would only come into Zambia about thirty days
[Minimum] after the repair authorization order is issued.
 The above point means the Lead time IRO repairs would be open-ended
 Due to damage to the Headrests, the seatbelts are most likely affected.
 Avoid a potential back and forth after I/V is worked on.
 Insured is a key contact at Tazama Pipelines and Tazama Petroleum Products.

An online search for replacement quotations has revealed the landing cost of this vehicle to be less
than the declared value/sum insured by only about 7%. It should further be noted that this vehicle is
a rare type and only found in specific markets thus the price is higher than your average Mercedes C-
Class Benz.

In view of the above, I recommend we ‘write off’ insured vehicle in order to maintain a good
business relationship with the insured who happens to be the Assistant Insurance officer at Tazama.

Subject to your approval, we may settle claim based on the Sum Insured.

Proposed salvage value is K 70,000.00

Computation of claim below:

Sum Insured: ZMW 280,000.00

Less 10% Excess: ZMW 28,000.00

Total net Claim Amount: ZMW 252,000.00
