With 1st reference cited supra, it is submitted humbly that this is a


petition presented by Smt Marpu Kumari w/o Prasad, age 40 yrs, r/o
Ambedkar Nagar, Inkollu village, against Kadiyalla Srimannarayana and 1
another during SPANDA programme held by the kind Supdt of Police on
09.05.2022 and the same was endorsed to me for enquiry and report.

Brief facts of the petition:-


“ The petitioner is resident of Ambedkar Nagar, Inkollu village. One
person by name Govada Seetharavamma was purchased a house site from
Kadiyala Kotiswamulu father of Kadiyala Srimannarayana in the year 2000 by
paying Rs.40,000/-. In the year 2015 Govada Seetharavamma paid an amount
of Rs. 1,00,000/- to Kadiayala Koti Swamulu and executed sale agreement. But
Koti Swamulu didn’t register the house site in her favor. Later on 10.02.2022 the
son of Kotiswamulu by name Srimannarayana came to their house on abused
her in filthy language touching her caste name and threatened her with dire
consequences. The she lodged report in Inkollu PS and the same was registered
vide Cr.No. 30/2022 under atrocity act. On 24.02.2022 the DSP, Chirala came
and examined the witnesses. Later the same house site was registered in favor
of Anaparthi Kumari w/o Subbarao at SRO, Inkollu vide document No.
314/2022. Since Srimannarayana, Vasanth Srikanth and Kadiayala Venkata
Narayana registered the house site in favor of Anaparthi Kumari, the said
Anaparthi Kumari is waiting for opportunity to grab her house site. Hence she
requested to arrest the accused and give protection to her. Sd/- M.Kumari.

It is further submitted that on 22.02.2022 at 13.30 hours, the


petitioner approached Inkollu Police Station and lodged report stating that she
has been residing in an asbestos sheet roofed house situated in Ambedkar
Nagar, Inkollu village which was purchased by her mother-in-law viz; Govada
Seetharavamma from a person by name Kadiyala Kotiswamulu by executing a
sale agreement in the year 2000. While so on 10.02.2022 at about 09.00
hours., while the petitioner along with a coolie are curing the newly
constructed walls with water, the respondents Kadiyala Srimannarayana and
Vasantha Srikanth came to the house of petitioner, abused her in filthy
language touching her caste name and threatened her with dire consequences,
that they will see her end unless they vacated the house site.

In this connection a case in Cr.No. 30/2022 U/Sec 509, 506 r/w


34 IPC & Sec. 3(1)(r)(s) & Sec 3(2)(va) of SC, ST (POA) Act-1989 of Inkollu PS
was registered on 22.02.2022 at 13.30 hours and investigation is in progress.
During investigation, I have examined as many as 10 witnesses including the
petitioner and recorded their detailed statements U/sec 161(3) Cr.P.C. During
examination except the petitioner none of the direct witnesses supported the
version of the petitioner.

In this issue main allegation is that husband of petitioner who


executed lease agreement with the father of Kadiyala Srimannarayana, violated
the terms and conditions mentioned in the agreement. However the issue i.e.,
the ownership of the disputed house site is to be judged by the Hon’ble Civil
Court.
