Narrator: Please rise. The Court is now in session, the Honorable Judge Billy Joe Bautista presiding.

JUDGE: Please be seated. Ladies and gentlemen of the jury, this is a criminal case alleging that on 27 th day of September
2015, defendants;

1. Joshua Bancifra alias Josh, 27 years old, single, jobless, a resident of no 76-E Bernal St., Brgy. Rosario, Pasig City,
2. Ivander Baldo alias Ivan, 27 years old, single, jobless, a resident of No. Unit E One Louie Apartment, Jasmin St.,
Brgy. Talon 5, Las Pinas City;
3. Arvie Manahan alias Cong, 47 years old, married jobless, a resident of No. 76-E Bernal St., Brgy. Rosario, Pasig
City

…in the cases of Violation of Section 5 (Selling of Illegal Drugs) in relation to Section 26 (Attempt/ Conspiracy) and
Section 11 (Illegal Possession of Dangerous Drugs), Article 2 of Republic Act 9165, otherwise known as the
Comprehensive Dangerous Drug Act of 2002 and violation of Republic Act 10591, otherwise known as Comprehensive
Firearms and Ammunition Regulation.

JUDGE: The first part of the trial is called VOIR DIRE means to speak the truth, and it is the time of the trial when I must
determine whether or not each and every juror of prejudice and can render a fair and impartial verdict based solely
upon the evidence that they hear in the case, or may have heard or read in the media, or saw on a television, or may
have heard by hearsay or gossip. Therefore, I first want to know if any jurors have heard anything in the past, or read
anything about this case?

JURORS: No, Judge.

JUDGE: Is each and every juror here willing to take an oath, the highest form of promise that a citizen can give, that they
will render an impartial verdict based solely on the evidence?
JURORS: Yes, Judge.

JUDGE: All right, then, let me explain the jury the different part of a trial. Because the state must prove guilt beyond
reasonable doubt, it us up to the state to proceed first, so you will first hear the opening statement of the Attorney’s for
Joshua Bancifra, Ivan Baldo and Arvie Manahan.

After opening statements, you will hear the states witnesses and after that, either or both defendants may call a
witness they choose. Any witness called by any party may be cross-examined by any other party. After you hear all the
evidence from the witnesses, you will then hear the closing arguments—first from the state’s attorney and then from
the attorneys for the defendants. After the closing arguments are completed, I will give you instructions on the law to
help you in your deliberations. Is the State ready to proceed?

PROSECUTION: Yes, Your Honor.

JUDGE: Is the defendant Joshua Bancifra, Ivander Baldo and Arvie Manahan ready to proceed?

DEFENSE: Yes, Your Honor.

PROSECUTION: The State calls Rogie Buenaventura. (Police Officer)

Rogie: I do.

Rogie: I’am Police Chief Master Sergeant Rogie Buenaventura.

JUDGE: It is now time for me to instruct you on the law of this case, after which you will be asked to deliberate and
determine if the State (Prosecution) has proven its case against either or both defendants beyond a reasonable degree
of doubt.

CLERK: As to the charges against, Joshua Bancifra alias Josh, Ivander Baldo alias Ivan and Arvie Manahan alias Cong, Hall
of Justice Pasig City under the presiding Judge Honorable Billy Joe Bautista, this Court finds that:
