Resolution No. 1, s. 2022

A RESOLUTION STRENGTHENING THE PROHIBITING OF CELL PHONES FOR


STUDENTS INSIDE THE SCHOOL PREMISES DURING REGULAR CLASS HOURS
UNLESS DULY NECESSARY

Whereas, as stipulated in DEPED ORDER NO. 83, S. 2003 – REITERATION TO DECS


ORDERS NOS. 70, S. 1999 AND 26, S. 2000 (PROHIBITING STUDENTS OF
ELEMENTARY AND SECONDARY SCHOOLS FROM USING CELLULAR PHONES AND
PAGERS DURING CLASS HOURS), the following policies regarding the prohibition on the
use of cell phones are hereby reiterated:
1. The Department of Education (DepED) strictly imposes a ban on the use of cell phones
by the students during class hours; and
2. Teachers and parents should devise ways to educate students on the responsible use of
cell phones to prevent them from engaging in misguided and immoral activities.

Whereas, the Miguel L. Daclan National High School-Supreme Student Government


(MLDNHS-SSG) Office has received reports that many students are seen to have been using
their cell phones in class and within the school premises. The use of cell phones,
specifically through apps like Facebook, TikTok, Mobile Legends, and others, has diverted
students' attention away from their studies. Worse, reports claim that the use of social
media apps and mobile games are disrupting classes.

Whereas, it has been also noted that cell phones have been proliferated with lewd and
obscene picture and videos particularly those capable of Multi-Media Services (MMS) and
have access to the internet.

Whereas, when using cell phones, the attention of the students is divided between two
tasks: what the teacher is attempting to teach and what the student is attempting to do on
the digital device. As a result, fewer items related to those two tasks will be remembered or
retained.

Whereas, under Section 2.5, Article VII of the Supreme Student Government Constitution
and By-Laws, the SSG must plan, to implement, and to inforce policies designed to protect
and promote the students' rights and welfare.

Whereas, the MLDNHS-SSG shall impose the following rules and regulations regarding this
matter:
1. Unless the bringing of cell phones shall be duly acknowledged by the adviser or subject
teacher requiring the use of cell phones in accordance to their respective lessons,
students are strictly prohibited to bring their personal cell phones and other digital

devices to school, especially using the gadgets during class hours wherein students can
easily be distracted.
2. Unless duly necessary, students are not allowed to charge their personal devices in any
building or facility inside the school premises.
3. The use of phones even when there is no teacher present or during breaks, as long as
students are within the school premises, shall not be allowed.
4. To permit the students to bring their personal phones for whatever reason it may be, as
long as it is used for their respective lessons or is entirely necessary for emergency
purposes, the students must submit a permission letter to their adviser or subject
teacher to be able to use their gadgets at a specific time only.
5. The MLDNHS-SSG shall monitor each classroom, and if necessary, assign class
monitors to identify the students who are using or bringing their personal phones in
school.
6. If caught using or bringing cell phones and other digital devices, the MLDNHS-SSG
shall implement the following penalties:
 First offense: If caught by a teacher or assigned monitor personnel for the first
time, the student shall be given a warning.
 Second offense: If caught by a teacher or assigned monitor personnel for the
second time, the device of the student shall be confiscated and shall be returned
at the end of class hours.
 Third offense: If caught by a teacher or assigned monitor personnel for the third
time, the device shall be confiscated and the student shall pay a fine of 10.00
pesos to retrieve the device after class hours.
 Fourth offense: If caught by a teacher or assigned monitor personnel for the
third time, the device shall be confiscated and the student shall pay a fine of
20.00 pesos. This time, the parent/guardian of the student shall personally
retrieve the device after class hours.

Whereas, the money to be collected shall be an income-generated fund for the future
programs of the MLDNHS-SSG, and other necessary projects.

Whereas, the MLDNHS-SSG shall be the role model of the students, thus, they are strictly
required to follow the above-mentioned rules and regulations.
