Facts

In compliance with the partnership requirements of the Civil Code, SAFA Law Office established
a partnership. According to the Record, on June 11, 1998, SAFA Law Office and Philippine
National Bank entered into a lease agreement, whereby PNB agreed to lease 632 square
meters of the second floor of the their Financial Center Building in Quezon City for three years
and for a monthly rental fee of P189,600. The rental fee is subject to a yearly escalation rate of
10%. The SAFA Law Firm thereafter moved into the rented space and made payments totaling
P1,137,600 for the advance rental fees and security deposit. On August 1, 2001, the Contract of
Lease expired and based on PNB, the respondent, SAFA Law office stopped paying its rental
fees after December 2002 but continued to occupy the premises until February 2005, although
the contract expired on August 1, 2001.
