BROKER AGREEMENT
ACL Contracting Inc. agrees to pay $___________ per hour for ____________________
during the 2022/2023 winter season to _____________________________________________
(herein after referred to as the Broker).

The said broker agrees to be available for work on a 24 hour on-call basis from November
1st, 2022 to April 15, 2023.

ACL Contracting Inc. agrees to pay a minimum of ____ hours during the season, subject
to attached conditions - Schedule A.

Should the total minimum hours not be worked and the broker has met all requirements
as set out in Schedule A, any outstanding balance (i.e. remaining hours x hourly rate) will
be paid on April 15, 2023.

The broker will also keep his/her truck(s) or equipment in a well maintained condition in
order to avoid unavailability due to breakdowns.

The broker acknowledges receipt of, and will familiarize with ACL route sheets and maps.

When it is snowing it is the responsibility of the broker to be available for work. Should
they not be available at a telephone number(s) they have provided to ACL - they should
notify ACL, at the telephone number provided, (289-242-6767) where they can be
contacted.

Any damage, however caused, must be reported to ACL immediately and is the
responsibility of the driver/owner. It is a condition of hiring that the broker provides ACL
with the details of his/her current insurance.

SCHEDULE A
GUARANTEE ‘NON-AVAILABILITY CONDITIONS’

Deductions from guarantee will be made if:


1. Broker is not available to work when called.
2. The office is unable to contact the broker. All phones numbers
supplied to the office will be called at least 3 times over a 1 hour
period. If you are not going to be available at the numbers you
have supplied to us, please leave a contact number on the broker
line answering service. 289-242-6767
3. Leaving early. If for any reason, when plowing and the brokers
route is complete, but the 'AREA' the broker is assigned to is not
complete, the broker should be available to assist other routes in
the SAME AREA which are not complete. Penalty will be the
difference in average hours worked for other brokers in your area
and own hours.
4. Breakdowns - including time to and from repair shop.
5. General wasting of time i.e. excessive time taken to complete

plowing or if broker is not able to be located while on route.


The first deduction under item 1 or 2 will be 10 hours. The second occasion will result in
an additional 20 hours and a third occasion will result in this agreement being rendered
NULL & VOID. Under these circumstances payment will be only for hours worked.
