    Johnrry Cayapas and his friend witnessed Ronald Garcia and Jenelyn Hamaybay using illegal drugs on private property. They took photos as evidence but did not report it for 3 days due to their conscience. When they did report it to Police Officer Aljem Castillo, he was convinced there was probable cause based on the evidence. Officer Castillo made affidavits and presented them to a judge, who also found probable cause that evidence of a crime may be found. This allowed the judge to issue a search warrant for the premises of Ronald Garcia and Jenelyn Hamaybay to seize any evidence in accordance with the law.

    SITUATION

    According to Johnrry Cayapas and his friend Claudio Miral resident in Basay brgy. Tabuan when they
    went to brgy. Banga Bayawan City on March 03, 2023 at exact 4pm, they notice that there are two
    person identified as Ronald Garcia and Jenelyn Hamaybay use an illegal drugs in a private property and
    they take pictures use as an evidence if they want to report in the Police Station. After 3 days before it
    happened Johnry Cayapas and his friend did'nt sleep because of their conscience and they went to the
    Police Station to report to the Police Officer Aljem Castillo. Because of the evidence he showed the
    Police Officer Aljem Castillo convinced that there have a probable cause.

    Police officer Aljem Castillo make affidavits written statements under the oath that contain information
    regarding the observations of the citizens, undercover, police informants or even police themselves of
    the criminal activity to provide to the judge conviencing him of the need for search warrant. Judge
    convinced that there is a probable cause that the evidence of a crime that occured may be found at the
    specified location, or that criminal activity taking place.

    It appeared to tthe satisfaction of the undersigned after the examining JOHNREY CAYAPAS under oath, the
    applicant of the Search Warrrant together with his witness, that there is probable cause to believe that tthe
    respondent is engaged the act constituting a violation of RA 9165 (Comprehensive dangerous drug act of 2002).

    WHEREOF, you are hereby commanded to make an immediate search ANYTIME OF THE DAY OR NIGHT in the
    premises of RONALD GARCIA and JENELYN HAMAYBAY located at Barangay, Banga, Bayawan, City, Negros
    Oriental in the sketch specifically describe attach to the Search Warrant as Annex "A" seize and to make return
    with in accordance with the law.
