Re: COVID-19 Origins FOIA Lawsuits
Dear Chairman Comer and Chairman Wenstrup:
I’m writing in reference to your ongoing investigation into the origins of COVID-19 and
related matters. A recent article in the Washington Examiner entitled “FBI and State
Department miss congressional deadline for documents on COVID-19 origins” caught
my eye because Citizens United is also fighting for some long overdue transparency on
this critically important issue.

I wanted to bring to your attention two separate Freedom of Information Act lawsuits that
Citizens United filed in U.S. District Court in the District of Columbia against the State
Department in 2021 for records relating to the origins of COVID-19 and the World
Health Organization report that characterized the lab leak theory as “extremely unlikely.”

Specifically, Citizens United requested the following information from the State
Department:

CU v. State, 21-cv-1662: All emails, letters, and/or memos sent to or from or


drafted by the following Department of State employees: Representative of the
United States of America to the United Nations, Ambassador Linda Thomas-
Greenfield; Deputy Representative of the United States of America to the United
Nations, Ambassador Richard M. Mills, Jr.; United States Mission to the United
Nations Chief of Staff Jennifer Davis; United States Mission to the United Nations
Director of Communications Olivia Dalton; Chargé d’Affaires at the US Embassy
in Beijing Robert W. Forden; Acting Deputy Chief of Mission at the US Embassy
in Beijing William Klein; Counselor for Public Affairs at the US Embassy in
Beijing Jeffrey Loree; Acting Assistant Secretary, Bureau of East Asian and
Pacific Affairs, Sung Kim; Deputy Assistant Secretary for the Office of Public
Affairs and Public Diplomacy, Bureau of East Asian and Pacific Affairs, Richard
Buangan; Executive Director, Bureau of East Asian and Pacific Affairs, G.
Kathleen Hill; Principal Deputy Assistant Secretary, Bureau of East Asian and
Pacific Affairs, Atul Keshap; Deputy Assistant Secretary, Bureau of East Asian
and Pacific Affairs, Dr. Jung H. Pak; Department Spokesperson Ned Price; Deputy
Spokesperson John T. Ice; and/or Principal Deputy Spokesperson Jalina Porter
including the following terms: Report of the WHO-China Joint Mission on
Coronavirus Disease 2019; Dr. Tedros Adhanom Ghebreyesus; World Health
Organization; WHO; WHO-Convened; COVID; Origin; Wuhan; Lab; and/or Lab
Leak. Time period: 2/1/21 to 4/8/21.

CU v. State, 21-cv-2340: All emails, memos and/or letters to or from or drafted by


the following current or former State Department Wuhan Consulate or U.S.
Embassy China employees: B. Jamison “Jamie” Fouss; Russell Westergard;
Christopher Green; Henley Jones; Charles Montgomery; Sarah Nelson; Michael
Dubray; Damian Richard; David Nicholas; Xenia Jones; Scott Tolsma; Kathleen
Hare; Nikolas Trendowski; Joel Christensen; Michael Escalona; Richard Jo;
and/or Brian “Rick” Switzer including any of the following terms: Wuhan
Municipal Health Commission (WMHC); Wuhan Institute Of Virology (WIV);
Market; Laboratory (Lab); Biological (Bio); Bio-Safety; Bioresearch; Switzer; Dr.
Li Wenliang; World Health Organization (WHO); Dr. Tedros Adhanom
Ghebreyesus; Dr. Anthony Fauci; Dr. George Gao; or Dr. Zunyou Wu. Time
period: 10/15/19 to 03/01/20.

While Citizens United is receiving regular document productions in these two cases, the
records are heavily redacted to put it mildly. We consider the Biden Administration to be
the least transparent in history and unfortunately this extends to the origins of COVID-19.
For example, the government informed Citizens United in a recent Joint Status Report in
case 21-cv-1662 that “the Department anticipates completing processing of these records
by the end of 2025.” This foot-dragging is completely unacceptable.

I believe these two FOIA cases could assist you in your investigation and provide some
much needed sunlight on the pandemic that took the lives of over one million Americans.
The American people deserve to see these records without the absurd redactions. It’s
also imperative for Congress to obtain all relevant information from the executive branch
