AFFIDAVIT FOR WARRANT OF ARREST AND DETENTION
‘The undersigned Afffant, who after being duly sworn By me, on oath, makes the following statement
have good reason to believe and do believe that:
(Suspect) ALEXI GIOVANNY RIVAS PINEDA (Race) HISPANIC/LATINO (Sex) MALE
(DOB) 04/24/1986,
(On or about 03-15-2023, inthe incorporated limits ofthe City of Austin,
County of Travis, Texas, did then and there commit the offense of
ARSON INTEND DAMAGE HAB/PLACE OF WORSHIP IAT--(1st Degree Felony)
My belief of the foregoing statement is based on the following information:
4 Fire and Arson Investigator assigned to the Austin Fire Department, and who
Affiant is LT Brian Thompson,
Fire that occurred at 1100 Reinli St., Austin,
has been assigned case follow up duties with regard to a Structure
Travis County, Texas around 2:18am on March 15", 2022.
‘Affiant has obtained the following information through personal knowledge, information provided by other
‘AED investigators during the course of their investigation, victim interviews, and information contained in APD
offense report number 2023-0740122
On 03/15/2023 at approximately 02:18, the Austin Fire Department responded to a reported structure fire
AY located st 1100 Reinl St. #155, the City View a Mueller Apis. Fir crews aived on scene and found heavy
fire on the exterior south wall of the building and it had breached the attic space. Fire crews extinguished the
fire with on-scene resources but not before an estimated $225,000 worth of damage had occurred. Fire
Investigators were then requested to the scene to assist with fire cause determination. Fire Investigators arrived
and after a thorough scene exam and witness interviews, classified the fie as incendiary.
Fire/Arson Investigators discovered that a bag of trash was placed against the wood exterior siding of building 4
next to residential apartment 155. Fire Investigators conducted a delayering process and did not find any viable
ignition sources within the debris and thereby ruled out any accidental causes. Investigators determined the
ignition source to be an open flame device used by someone to ignite the bag of trash atthe base of the exterior
wall. Investigators were able to identify contents inside the fire debris from the bag of trash and that the bag,
remains were a white plastic trash bag,
Fire/Arson Investigators interviewed witnesses on scene and spoke with a resident who was identified as;
LEONARD, JESSICA (B/F 1/15/2000). LEONARD, J lived in apartment 130 and stated that there were two
bags of trash outside her apartment. A white bag and a black bag, The black bag was still outside the
‘apartment. LEONARD, J was asked by investigators if should could identify contents of the trash that she had
put out in the white plastic bag. She stated there was a green Gain laundry soap bottle and a juice container.
‘When she was shown the contents, she stated that it was definitely the juice container and the rest of the trash
was hers.
Fire/Arson investigators also interviewed her sister, LEONARD, AMBER (B/F, 2/14/1999). LEON,
{iss the 911 caller and sated that she walked out of her apartment and smelled the stoke and sow thee den

exterior area. She stated that the Hispanic male, identified as;
RIVAS PINEDA, ALEXI GIOVANNY, DOB 04/24/1986,
‘Who lives in the apartment 129, was captured on her camera video outside her apartment looking around, then
RIVAS PINEDA picks up the white bag of trash and walks away at 2:15:55am. He retums at 2:16:35am
smoking a cigarette, throws it on the ground and enters his apartment. LEONARD, A exits her apartment at
2:17:19am to go to Whataburger and she smells the smoke, looks around the comer and sees the fire. She is
seen on the video calling 911. AFD call reports show that the 911 caller name was Amber.
RIVAS PINEDA was located by fire investigators on scene and was wearing similar clothing as was observed
in the video. He was asked if he picked up the bag of trash and he admitted to that fact, RIVAS PINEDA
stated that he was frustrated with his neighbor always leaving trash outside and he said that he took the one bag
to the “dump”. Fire Investigators asked for him to show where he took this bag of trash. He took them on a
walk through the complex to a trash dumpster located in the parking lot. It was determined, by fire
investigators that the distance traveled to the parking lot from the apartment was too far to have retumed in the
less than 1 minute as seen on the door bell video. When RIVAS PINEDA was questioned about specifics of
the trash and the fire, he became agitated and expressed his anger with the neighbors.
Fire investigators detected the presence of an alcohol odor on RIVAS PINEDA and he also appeared off
balance when he was being questioned, His demeanor and speech led investigators to give reasonable suspicion
that he was intoxicated at the present time.
Based on the facts of the investigation, and all interviews observed, Affiant believes the intent of RIVAS
PINEDA was to cause damage to the multi-family residential structure when he took the bag of trash from the
doorway of apartment 129, out of the expressed anger, and placed it next to the window of apartment 15
Building 4. Affiant believes that RIVAS PINEDA knew that he did not want to bum down or cause damage to
his own apartment where he immediately ran back to after igniting the fire, but was cognitive enough to place
the bag of trash against a separate building to cause the damage.
This offense occurred when RIVAS PINEDA, ALEXI G, (H/M DOB 04/24/1986), intentionally started a fire
regardless of whether the fire continues after ignition, or causes an explosion with intent to destroy or damage:
any building, habitation, or vehicle, and thereby meets the elements of Arson, a First Degree Felony as set forth
in Penal Code Chapter 28.02.
