(a) `Appointing Authority' means the Governor ofAssam;

a) .Sdection Bond' means the Selection Board constituted

under rule 12;

(c) `Cotmisston' means the Assan public ser`/ice commission;

a) `Member' means a member of the Assam panchayat and

Ruul I)evelopment OffLc€rs qngineering) S€rvit€.

(i) `Selest List' means the list recommended by the commission

and Board for recnlitment to a cadre both by direct
recruit[nent or by promotion as per Rule-6 and Rule-13
respectively;

(J) `Service' mcane the A8sam P&nchayat and Rural Development

Officers Qngineering) Servl€€;

(k) .Y€&r' means calendar year, i.e. from January to December ;-

(2) The Service shall also include;

(a) any post equiwlent to a post in any of the cadres mentioned

in sub-rule(I) above;

a cadre or the service.

(3} The posts equivalent to the posts in the cadres Of the Service as
on the date of colrmencement of these rules are as mentioned in
Schedule - I.

Strength of 4. The strength Of each cads of the Service shall be such as may be
Service determined by the Governor from time to time. The strength of the
cadres Of the service oa the date Of commencement of these Rules
shall be as provided in Schedde -I :

Provided that the Goverment_ may hold in abeyance any post

as and when considered necessary.

Method of S. Recruitment tQ the cadres of the Service chall be mere in the

(i) Recruitment to the cadre of Joint Commissioner qechnical)

shall be made by promotion in accordance with the
provisions of Rule 11 and Rule 13 of these rules.

(ii) Ebequitment to the cadre of Assistant Commissioner

greelinieal) and Excoutive Engineer shall be mndc by
promotion in accordance with the provisions of Rule I I and
REe 13 of these rdes.

riii) Recruitment to the Cadre of Assistant Excoutive Engineer

shall be made by promotion in accordance with the
provisions Of Rule 11 and Rule 13 of these rules.

(iv) (a) 50% .to the cads of Assiseant EnSneer shall be made by
Direst Reoniitment in accordance with the provision of
Rule 6 of these ndes.

¢) 50% to the cads of Assistant Engineer shall be made by

promotion from Junior Engineer in accordance with the
provision ofRule I 1 of these rules:

Provided that from 50% of the said posts as a one

time measure, 5% of Junior Engineer posted at Zilla
Parishad level shall be promoted to the post of Assistant
Engineer, who shall be subsequently included after
promotion in the Common gradation list of Assistant
Engineer.
(v) Recruitment to the cadre of Junior Engineer shall be made by
Difeet Reeniitment in accordance with the provision of rule 6
Of these rules.

Procedure of 6. (1) Subject to clause (iv) of sub-nile (I) of rule 11, direct recruitment
Direct shall be made on the basis of reeommendatiors made by the
recruitment Commission in accordance with the procedure hereinafter
provided:-

(i) Before the end of each year (i.e. in the month of December)

(ii) The Appointing Authorty shall simultaneously request the

Comnd8sion to recommend a list of cndidates for direct
reouitrnent, in order of proference.

two or more candidates obutn eqiral macks, the Commission

the Appointhg Authorty.

¢v)Ihe Commission chall furnish to the Appointing Authority a

list Of candidrtes recommended by it in order Of prefaenee,
found suitable for direct recmitrent crowing the mrks

number of candidates in such a list shall be equal to the
number of vacancies notified.

(v) The Commission chall simultaneously publish the Select List

in the Assain Gazette and or at such other place the
Commission may consider proper.

rule shall lrmrain valid for 12 calendar months from the date of
reconmendrfu

G) In the event of the Commission being unable to recommend

sufficient number of candidates to fill all the vacancies in a year,

Recruitm€ntby 11. Recruitmentbypromotioninthecadreshallbesubjecttofollowing:-
Promotion
(1) Subject to suitability as ilmy be decided by the Selection Board
and by the Appointing Authority in accordance with the
procedue as set forth in nlle 13, a member shall be eligivle for
promotion to the corresponding higha cads in the manner
hereinafterprovided:-
(1) Reeruitmeut to the post of Joint Cormissioner {Technical)
shall be nde by promotion from the post of Assistant
Comulssioner a:echnical) or Executive Engineer who have
rendnd at leas( 7 (seven) years of continuous service and
merit in the edre of Assistant Commissioner Oechnical) or
Excndve Engineer.
(ii) Recniirfut to the post of Assistant Commissioner
qechnical) and Exeeutive Engineer shall be made by
promotion from the post of Assistant Executive Engineer
who have rendend at least 5 (five) years of continuous
service in the Cadre of Assistant Exeeutive Engineer.
(iii) Recruitment to the post of Assistant Executive Engineer
sml be made by promotion amongst the members of the
Service in the post Of Assistant Engneer who have rendered
at least 5 (five) years of continuous service in the cadre Of
Assistant Eingineers.
(iv) Recruitment to 50% of cadre strength of the Assistant
Engineer shall be filled up by promotion among the
members of the Service in the post of Junior Engineer of
Block Development I+evcl who have rendered at least 8
(eight) years of continuous service in the cadre of Junior
Enctneen:
Provided that as a one time measure 5% out of the
50% is earmarked for the Junior Enqneers of ZHla Pari§had
as mentioned in the proviso to clause to) of sub rule (iv) of
ule 5 above.

(2) Nctwithrmding anything contained hereinbefore in these rule,

subject to suitability, a Junior Engineer of the Assam Panchayat
and Rural Development aingineering) Service, on histher
acquiring the academic qualification, as prescribed for a direst
recruit of Assistan( Endrr, shall be promoted as Assistant
Engineer, in consutation with the Commission, such promotion
shall be teased as direct oecrtiitment to the edre of Assistant
EngineerforthepurposeoftheseRules.

(3) In case of specializndon of a member of the service posted in

cormection with the specialized subject, shall be retained in the
sane spcoialized work, on his promotion in the norml course by
creation Of higher post in the cadre to which he is so promoted,
keeping the lower-post in abeyance, if the Goverment considers
that such an officer cannot be wlthdmwn from specialized work
due to nun-availabilfty of any other Officer of the lower or
equivalentcadreintheservicetoperfomthespecializedwork.

(4) Subject to suitability as may be decided by the Appointing

Authority as set foth in rule 13 and also subject to posseesing
qualificationsandexperienceasprescribedinsub-rule(I)above,
an officer §hau be eligible for promotion from one cadre to
another of the service.

General procedul'e 13. (1) Before the end of each year the Appointing Authority shall
Ofpronotion malre an arsesanent Of the likely number of vacancies to be
filledbypromotioninthenextyearincachcadre.

(2) The Appoinrfug Authority shall then furnish to the Board the
following documents and information with regard to as many
officers in order, of seniority as are eligible for promotion:-
(a) Infomation about the number of vacancies;
®) List of officers in order of seniority, eligible for
promotion (seprrate list for promotion to different
cadres shall be famished) indicating the cadre to which
the case of promotion is to be connected;

(c) Chamcter rous and persoml files of the officer listed;

(3) The Appointing Authority chall simultaneously request the

Selection Bond to recommend within one month a list of
officers, found suital>le for promotion in order Of preference, in
respeet of promotion to each of the cadre in which recruitment
is to be made by promotion.

(4) The selection shall be made on the basis of seniority with due
regrd to merit in case of promotions stated before under rule
11.

(5) The Selection Board, after examination of the documents and

infofmation firmished ty the Appointing Authority shall
recommend to the Appointing Athority a list of officers
against the number of vacancies, in order of preference, fo`ind
suitable for promotion.

(® The Appointing Authority on receipt of the lists recommended

by the Board shall consider the list prapared by the Board along
with chancter rolls and persoml files of the employees and
approve the list unless it considers any change necessary. If the
Appointing Authority considers it necessary to make any
change in the List Deceived from the Selection Board, he shall
infonn the Selection Board of the changes proposed and after
taking into account the comments, if any, of the Board may
approve the list finally with such modifications if any, as may,
in his opinion, bejust and proper.

(7) The inclusion of a candidate's name in a Select List shall confer

no right to promotion unless the Appointing Authority is
satisfied after s`ich enquiry as may considered necessary that a
candidate is suitable for promotion.

(8) The Select List finally approved by the Appointing Authority

shall bc published by the Appoindng Authority within 15 days
from the date of final approval.

(9) The Scleeted List shall remedn valid for 12 calendar months
from the date of approval by the Bound as the case may be.

(10) The promotions chaLI be in accordance with lists finally

approved.

Disqunlffication 14. (I) No person chaLl be eligible for appointment to the service,-

(i) Unless ha/she is acitiaen ofhdia;

(ii) Ir he has more than one wife living or in case of a fermlc

candidate who has married a person who has wife living:
Provided that the Governor may, if he/the is
satisfied that there is a special ground for doing so,
exempt any person from the operation of this clause.

(iii) If a person violates the legal age of mandage; and

(iv) If he does not comply to the provisions of Assan Public

Services (Application of small finily noms in direct

(2) No person who attempts to enlist suppo`rt for his candidature

directly or indirectly by any reeormendrtion, either whtten or
ord or by any other means, shall be appointed to the service.

Reservation 15. In all cases of appointment by direct recruitment as well as by

promotion. there shall be reservation in case of candidates
belonging to the member of Scheduled Castes, Scheduled Tribes as
per the provision of_the Assan Scheduled Castes, Scheduled Tribes
(Resermtion of Vacancies in Services and Posts) Act, 1978 and
Rules fromed there under and amendments and Ofrice
Memorandum issued by Gorrernment from tine to time. There shall
be also reservation for candidates belonctng to Other Backward
Classes as per Government instructions contajncd in
OM.NO.TAB/OBC/lre004/55 dated 31-05-2005 for direct
recruttnertychy.RescrvinoninfavouofwomenaspertheAssam
Women akeservation of Vacancies in Service and Post) Act, 2005
and Person with Disabilities a3qual Opportunities, Protection of
right and Full Participation) Act. 1995 shall also be follo\nd in
dircet recruitment.

Appointment 16. (I) All appointments to the service shall be made by the Governor
and shall be notified in the Official Gazette.

(2) Subject to the provision Of sub-r`ile (2) of this rule, the

appointment under rule 6 shall be made by the Appointing
Authority in accordance with the order of preference
detemined in the list ref:rfed to in clause (d) of sub-rule (1) of
rule 6.

(3) The inclusion of a candidate's name in the Select List

mentioned in clause (iv) of sub-nile (1) of r`ile 6 shall confer no
rigiv to appoinment unless the Appointing Authority is
satisfied after such enquiry as prescribed by the Government
from time to tine and also, as may be considered necessary,
that a candidate is suitable in all respects for appointment to the
service.

Joining Time 17. A person shall join within l5 days from the date of receipt of the
order of appointment, or Of promotion, failing which the
appoinment shall be cancelled unless the Appointing Authority
extends the pchod, which shad not, in all, exceed thee months.

Training 18. A member of the service shall be required to undergo sush training
and prss such dapartmeml examination as Government may
presodbe.

Discharged or 19. A temporary or officiating member shall be liable to be discharged

reversion or reverted to the lower cadre of the 8erviee or to his/her original
services, if,-
(i) Hefehe fails to rake sufficient use of the opportunities
given during any training as may be prescribed by the
Government from time to time, fails to render satisfactory
service during histher tenure service in the cadre; and/or

(ii) It is found on a subsequent vchfication the( he/the was

initially not qualified for the appoinment or that he/she
her fumiched any incorrect infomation with regard to
hisha appoinment.

Seniority 20. (1) The seniority of a member in a cadre appointed by direct

recruitment or by promotion shall be detemined according to
the order of preference in the respective Select List
recommended by the Selection Board under rule 6 and rule I 3
and also in the reapective list finally approved by the
Appointing Authority, if he/the jofus the appointment within 15
days from the date of receipt of the order or within the extended
period as mendoned in rule I 7.

(2) If a member falls to join the appoinment within the initial 15

days Of receipt of the order or within the extended period, as
mentioned in rule 17, but joins later, histher seniority shall be
determined in accordance with the date ofjoining,

(3) A member appointed by promotion in a year shall be senior to a

member of that cadre appointed by direst recniiment in that
year.

Probation 21. (I) Sutiect to avallabilfty ofa permanent vacaliey in the respective
and cadre member shall be placed, according to schority on
conrLr"tlotL probation against the pemanent vacaney for a period of two
years before hofche is confined against the pemanent post:
Provided that the pedod of i>rohation "y for good
and sufficient reasons be exfroded by the Appointing A`Ithority
for any special period, not exceeding a period of t`ro years:

Provided further that the period Of probation may be

curtailed or dispensed within any case for good and sufficient
reasons by the Appointing Authority.

(2) A member of the service pheed on probation under sub-rule (I)

above, shall be confined against the pemanent post sutyect to
the following conditions:-
(i) Hc/che has complcted the period of probation to the
satisfaction of Appointing Authority in accordance with
sub-mle (I) above;
(ii) He/the has successfully undergone the training and
passed the pepartmental Exanimtion, if any,
preschbed by Government under rule 18.

(3) If confimation of a me(nber is delayed on account Of histher

failure to quality for such confimation he/she chall lose his/her
position in order of seniority vis-a-vis such of histher junior as
might be confined earlier than himther. His/her Seniority shall,
however, be restored on histher confimation subsequently.

Gmdation 22. Gradation list shall be prepared and published every year
List containing the name of all members of the service cadre-wise in
order of Seniority and sueh other particulars as date of birth, date of
appointment, eta.

Pay 23. Au appoinment in the service shall be made in the time scale of
pay as may be putlished by the Goveniment from time to time. The
scale of pay of the posts in the cadres of the service, on the date Of
commencement of these niles is as cho`rm in Schedule-I.

Mode of 24. (I) Members of the Service chall be employed in sueh manner as
Employmen( the Appointing Authority may decide.

(2) A member of the Service shall be liable to be posted anywhere

within the State of Assam or outside Assam, or to any other
department of the Government, 8 body corporate, in the affairs
of wliich the Govcmment may be substantially interested, or an
• autonomous district council, if so requhed in the interest of
Public service and ill sueh case the member shall not have any
option against such posting or transfer.

Other 25. (1) Except as provided in these rules, all matters relating to pay and
Conditions of allowances, leave, pension, discipline and other conditions of
Service service shall be regulated by the general niles or orders of the
Government from the time being in force.

(2) The conditions of service of the members, in respect of matters,

for which no provision has been made in these rules, shall be
the same, as are, for the time being, applicable to other officers
of the Government] of the corresponding status and having
similar functions.

Rehation 26. Where the Government is satisfied that the operation Of any of
these rules, catLses under hardship in any particular case, it may,
dispense with or relax the recruitment of that rule to such extent
and subject to such conditions as it may consider necessary dealing
with the case in a just equitable manner:
