The webinar was about freedom of movement and immigration where freedom of
movement refers to right of individuals to travel from place to place within the territory of a
country, and to leave the country and return to it. On the other hand immigration is the international
movement of people to a destination country of which they are not natives or where they do not
possess citizenship in order to settle as permanent residents or naturalized citizens.

The panel who was Trisapto Wahyudi Agung Nugroho started his webinar session with an
introduction. Indonesia is one of the transit countries in South East Asia where there is a possibility
that the number of refugees will be increased. He stressed that right of children to education is one
of the fundamental rights and the research that was conducted will look at how the current practice
in Indonesia in regards to refugee’s children right to education, compared with Malaysia and
Thailand. The research will analyze the fulfillment of refugee’s child right to education as well as
the challenge and opportunity in manifesting the right in Indonesia.

Then there was the finding and results from the research that was explained by the panel,
where Indonesia, Thailand, and Malaysia are not the party, and also a transit country. Looking at
the practice done by Malaysia and Thailand, NGO and CBO are crucial in providing education.
There are no regulations concerning the fulfillment of refugee’s children’s right to education.
However, Indonesia has ratified several international conventions that oblige Indonesia to provide
the refugee’s children the right to education. Besides ratifying, Indonesia through the Ministry of
Education has issued a circular letter in regards to refugee but is inadequate in respects to
Indonesian Legal System where refugee regulation in Indonesia is not maximized.

As a conclusion, manifesting the right to education for refugee’s children is not impossible.
Indonesia has ratified several conventions, giving Indonesia Obligation to fulfill the right of the
refugee children. Looking at the practice done by Malaysia and Thailand, NGO and CBO are
crucial in providing education. A new regulation that deals specifically with the refugee issue
should be implemented and the new regulation should at least fulfill the refugee’s basic right.
