Facts: Mr. Estapa, senior paymaster of cash division in the city hall ofmanila, after withdrawing money
from central bank, had count the money ina certain room.After counting the money his supervisor asked
“ok na ba kayo diyan?” Prompting them to leave central bank. However, it was discovered that Mr.
Estapa had not voiced his problem that a certain amount worth P50, 000 was missing and he did not
prompt his supervisor of such problem.

Issue: Whether Mr. Estapa is liable under Art. 217 (4) of RPC.

Held: Yes. Under Article 217 of the Revised Penal Code, there is prima facie evidence of malversation
where the accountable public officer fails to have duly forthcoming any public funds  with which he is
chargeable upon demand by duly authorized officer.
