Nana | M, Adonis! | For your L.DeVelez | approval’ signature pms | nascoc | FYR Ee ‘DoT Compound, Ape Caut ratio St, cr, Oana Stak Freep Zane Parpange “nk une (03) 700896) Republic of the Philippines DEPARTMENT OF TRANSPORTATION MEMORANDUM For ‘The UNDERSECRETARY For Railways From: The PROJECT MANAGERS For North-South Commuter Railway Extension ("NSCR-EX”) Project Subject: NORTH-SOUTH COMMUTER RAILWAY EXTENSION (*NSCR-Ex’) PROJECT Nz; TREE CUTTING AND EARTH-BALLING FERMIT APPLICATIONS TO ‘THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES ((DENR’) IN CP N-02 AND CP N05} Date 11 August 2022 In ine with the implementation of the North-South Commuter Railway Clark Extension (ONSCR Clark Extension”) Project, trees located within the project right-of-way (ROW) ‘will have to be rsmoved to prepare the railway line and other structures free of obstruction, The basic law that guides tree removal in the country is PD 705 (Revised Forestry Code of 1975), which is supported by other issuances, such as the DENR Memorandum issued in 2009 (Guidelines and procedures on planting, maintenance and removal of trees and other vegetation), E023 issued in 2011 (Logging Moratorium in Natural and Residual Forests), DMO 2012-02 (Uniform Replacement Ratio for Cut/Relocated Trees), and DAO 2018-16 (Guidelines in the Processing and Issuance of Permits on the Removal and Relocation of ‘Trees Affected by DPWH Projects) as amended by DAO 2020-06 (Amending Certain Provisions and Expanding the Coverage of DAO 2018-16), among others, Since 2020, tree cutting and earth-balling permits have been secured from the concerned DENR field offices for the various segments of the project right-of-way (“PROW”), particularly in government-owned properties such as the Philippine National Railways PNR”) rightot-way. In view of the foregoing, may we please request for your approval and signature to the attached letters to DENR for the tree cutting and carth-balling permit applications in Contract Package Nos. 02 and 03, particularly for trees outside the Philippine National Railways ("PNR") lands. To date, your good office has already issued four (4) tree cuting and earth- balling permits to us. All of which were for tees located within government-owned lands. As previously discussed, the project also covers private lands where which ight- of-way and site acquisition (“ROWSA”) is ongoing. In a meeting last 01 March 2021 at the DENR Region 3 office, it was agreed that we may proceed to our applicaticn for these areas while the ROWSA process is still ongoing, provided that a suspensive condition or clause will be included in the permit (ae Annex 1) In this regard, we would like to apply for tree cutting and/or earth balling permit for Contract Package No.0, particularly for tees outside the Philippine National Ralvays (°PNR") lands To faite this application, enclosed inthis letter are the following documents 2).
