ORDINANCE NO. 2023-14 AN ORDINANCE TO AMEND THE ZONING MAP OF THE CITY OF LINCOLN, ALABAMA AND ORDINANCE NO. 2015-11 ENTITLED, “LINCOLN ZONING ORDINANCE” ENACTED PURSUANT TO THE AUTHORITY GRANTED BY TITLE 11- 52-70 THROUGH 84, INCLUSIVE, OF THE CODE OF ALABAMA, 1975, AS AMENDED; REPEALING ALL CONFLICTING ORDINANCES AND MAPS, AND PROVISIONS FOR AN EFFECTIVE DATE OF THIS ORDINANCE, WHEREAS, Title 11, Chapter 52, Code of Alabama, 1975, as amended, authorizes the City Couneil to enact a zoning ordinance to govern all territory within the corporate limits of the City of Lincoln, Alabama; and WHEREAS, the City of Lincoln, Alabama desires to continue exercising its zoning powers in accordance with Alabama law; and WHEREAS, the City of Lincoln Planning Commission has considered a petition for amendments to the Lincoln Zoning Ordinance upon which a public hearing was duly conducted and has submitted to the City Council of the City of Lincoln a formal written report and recommendation, for action regarding said petition; and WHEREAS, the City Council of the City of Lincoln has received a formal written report and recommendation from the City of Lincoln Planning Commission regarding a petition for amendments to said Lincoln Zoning Ordinance; and WHEREAS, the City Council also conducted a formal public hearing to receive public comments on the proposed revisions to the zoning ordinance and all applicable requirements of the Lincoln Zoning Ordinance and Title 11-52-77 of the Code of Alabama, 1975, as amended have been satisfied. NOW, THEREFORE, LET IT BE ORDAINED BY THE CITY COUNCIL OF THE CITY OF LINCOLN, ALABAMA AS FOLLOWS: SECTION 1: That Ordinance 2015-11 entitled the “Lincoln Zoning Ordinance” and/or the “Lincoln Alabama Zoning Map”, enacted pursuant to the authority granted by Title 11-52-70 through 11-52-84, inclusive of the Code of Alabama, 1975, as amended, be and the same is hereby amended. SECTION 2: To amend, format and codify ARTICLE IIL, Section 301, Zoning Districts, of the Lincoln Zoning Ordinance No. 2015-11 to add Resort Commercial RC as a new zoning district. SECTION 3: To amend, format and codify ARTICLE III, of the Lincoln Zoning Ordinance No. 2015-111 to add Section 305.14 Resort Commercial (RC). and the section read as follows: a. New development standard for the city. ‘This district is designed to accommodate new market concepts by encouraging mixed residential, hospitality and commercial development. This would include resort guest-oriented (hospitality) and commercial uses in a suburban setting. Particular uses and provisions are described in this District to encourage development, those uses and provisions not described in this District to encourage development, those uses and provisions not described shall follow provisions described in the other areas of the Ordinance. In particular this is to permit a commercial and a residential use to occupy the same building, such as a restaurant or offices on the main level and residential use on upper floors. Intent ~ The intent of this district is to recognize current developments on sites in addition to the potential for and encouragement of other uses which may be market indicated. In particular there is a noticeable shortage of multi-family housing in this market. This district may apply to areas with heavy traffic along frontage highways which would be discouraging for single family homes. Such as areas that have long been a primary area for manufactured homes and recreational vehicles, An important aspect of this district is to permit a very wide variety of uses to reflect the changing market demand for residents and visitors for living and recreations. While zoning tends to classify particular and like uses and activities that are recognized as long standing uses this Development District is intended to provide areas for new and innovative market activities that develop as a result of market changes, growth and changing demographics. In effect, this Development District, provides a venue for as yet unidentified needs of the community and some existing and early development trends. SECTION 4: To amend, format and codify ARTICLE IV, Section 402, Table 4-1 Table of Permitted Uses of the Lincoln Zoning Ordinance No. 2015-11 to add the new zoning district RC Resort Commercial to the Table and include the following as permitted uses in the RC Resort Commercial zoning district; Single Family Detached, Multi-Family, Bed & Breakfast Inn, Business/Professional Office, Barber/Beauty Shop, Convenience Store (no fuel), Entertainment — Indoor, Entertainment — Outdoor, Garden Center or Nursery, General Retail (Enclosed), Greenhouse/Farm Produce Sales, Recreation ~ Indoor, Restaurant - Eat-In, Shopping Center, Veterinary Office/Kennel Large Animal, Wine Bar/Brew Pub, Gasoline/service station, Hotel/Motel, Outdoor/Drive-In Theatre, Restaurant — Fast Food, Vehicle Sales or Rental, Neighborhood Shopping Ctr., Veterinary Office/kennel w/outdoor pens, Mini-warchouse, Miniature Golf/driving range, Amusement Park, Fairground, Amphitheater, Race track, Stadium/arena, Skate Rink, Campground, Cottages/cabins, a Recreation vehicle park, Golf Course, Park, Tennis Court, Swimming Pool, Communication Tower, Municipal Office/Facility and a Public Utility as set out below.
