TRO’s Comments:

The ITCP-1 of the I.T. Act has been issued on 04/01/2018. As reported by the Inspector,
the office has been closed therefore the ITCP-1 was served by affixture on 05/01/2018.
Further as reported in the local newspaper, the director of the company Shri Vinay
Phadnis has been arrested on 29/12/2017 by Nashik Police for financial fraud. In this
case Prosecution has been launched by the AO on 14/09/2017 and matter is pending
before the Civil Court. Its learnt that the case was fixed for hearing on 03-10-2019, but
nobody attended on behalf of the assessee.

The arrear demand notice dated 07/08/2018 for A.Ys.2012-13 to 2015-16 amounting to
Rs.3.7 Crs. was duly served by affixture by the Inspector for recovery.

Since the director of the company, Shri Vinay Phadnis, is presently behind the bars and
his Business premises i.e. ‘Kalpvriksha’ 100ft. DP Road, Karve Nagar, Pune has been
sealed by police authorities and the property sealed is under the possession of Central
Bank of India, recovery proceedings cannot be concluded. Courtesy letters sent to the
assessee has been returned back unserved by the postal authorities.

The undersigned is in constant touch with the Departmental Counsel, Shri Lalchand
Oswal with regard to above.
