In this case, the ITCP-1 of the I.T. Act has been issued on 23/01/2018. The Bank account
has already been attached on 28-12-.2017. Further the Show cause letter to the director
of the company Shri Chandrakant Mahadeo More has been issued on 04-07-2019.

Till the end of the last quarter, the payment of the assessee company paid stands at
Rs.39,74,273/- and the outstanding demand is Rs.1,25,33,398/-.

Assessee in response to this office letter dated 12.12.2019 attended this office on
13.12.2019 and re-iterated the status of the company that at present there is no money
available with the company. There is no business running since last 2 years. Also all
the bank accounts are attached by various banks. during F.Y.2017, his business
incurred heavy losses and there was huge pressure on him for vendor payment in cash,
cheque and stock sale / transfer. The business is closed, further all properties have
been attached by different Banks and all Bank accounts are also been freezed.

As per mail received on 13.12.2019 it is stated that its other two entities are also under
Corporate Insolvency Resolution Process. Assessee requested that once the process is
complete and the assets are sold and money realized, then only it would be able to
make the payment against the demand till then to co-operate. Proof of filing before CIR
process is being called for from assessee.

in response to the summons. Further, as a new incumbent TRO, courtesy letter to pay
outstanding demand is issued.

A.O. for the A.Ys 2016-17 and 2017-18.
The A.O. is requested to rectify the demand and inform the correct outstanding
demand accordingly.
