thoroughly considering all the issues involved and providing your own answer. Each question is worth 4
marks. Complete the following:

QUESTION 1

Describe “innocent absenteeism.” At what point will continued employment represent an undue
hardship in the context of innocent absenteeism?

QUESTION 2

Implied terms in law go beyond what contracting parties might be presumed to have intended when
making a particular type of contract, with the possible outcome of putting the judge in the role of
legislator. Are implied terms in law generally a good way of keeping up with social mores or do they
leave too much discretion to judges and reduce the ability of parties to make contracts that reflect their
desires?

QUESTION 3

While minimum wages are legislated, minimum hours are not. Should we be thinking about a way to
guarantee employees a certain number of hours per week as well as a certain amount of dollars per
hour? What problems do you think this would fix and what ones do you think it would create?

QUESTION 4

How reasonable do you believe the rules against discrimination are? Do you think that the attempt to
right the wrongs of discrimination have become too onerous upon employers?

QUESTION 5

Consider the following: A woman with child-care responsibilities could require a shift change in order to
meet those responsibilities and to not be discriminated against as a result of her family status. However,
that could require someone else to take that shift. What if that shift interferes with that person's
important extracurricular activities or important relationships but not in way that invites a legal claim for
discrimination? Do you believe that is fair? What answer would you propose to resolve this situation?
