3. The following facts and matters set out within this affidavit are within my own personal knowledge
except as otherwise stated.
BACKGROUND:
4. The most recent article titled “Basketball player does not make the cut” was published on
22 October 2022. The article critiqued my basketball skills and implied that I was
incompetent. It stated that my basketball contract was not going to be renewed due to my
lack of talent. However, my contract was renewed last month and Melbourne Fast Jets was
planning to make a public announcement on 1 November 2022.

5. In May 2022, LWD Newspaper published an article “Basketball star and his love child”
The source was a former girlfriend who had attended high school with him. She claimed
that I was the father to her 5-year-old son. The article stated, “I do not want anything to do
with the child, even though I am the father” When I read this article it was the first time, I
had heard any such thing. I subsequently arranged a DNA test which proved that I was not
the father. The newspaper did not issue an apology.
6. In January 2022, LWD Newspaper did a special story on a betting ring inside the Victorian
basketball clubs. The article stated that a number of basketball players placed bets on
basketball games, which was prohibited by the players’ code of conduct. Furthermore, the
sporting bets resulted in poor performance during basketball games. The article only
identified me as one of the key players involved in the scandal. The truth is that I had
never placed any bets on any sporting events and that the source was a disgruntled former
agent. I became very depressed.
8. LWD Newspaper published a story titled “Shooter or Looter?” The article was about
several individuals who were stealing items from abandoned houses which were damaged
due to an earthquake. The article included photographs of the alleged offenders. The article
suggested that one of the offenders was a basketball player. I received several abusive
posts on my social media accounts. Although it was not me in the photograph, people
believed it was me because the title of the article used his last name “Shooter” and the
article stated that the offender was a well-known basketball player. It was published on 20
August 2022. This article was subsequently shared on twitter received many retweets
mentioned in exhibit 1.
