PRESERVATION OF EVIDENCE DO’S AND DON’TS

All documents and information relevant to the litigation involving your assigned claim must be
preserved. Relevant information includes, but is not limited to, the following:
• Any communications with, assignment of your claim to, and payments received from
CirclesX or its employees or contractors;
• Any communications with, or billing statements from, your Retail Electric Provider
(REP) or other utility provider related to Winter Storm Uri and associated power outages;
• Any information about your loss and damage arising from Winter Storm Uri, including
bills, receipts, invoices, proof of payment, photographs, or videos;
• If you made an insurance claim from Winter Storm Uri, information and communications
regarding that claim and any money you may have received; and
• If you made a claim for financial assistance with FEMA or other relief organization or
governmental entity, all information and communications regarding that claim and any
money you may have received.

Do’s:
• Confirm that any relevant information stored on any electronic device you may use, i.e.,
laptops, tablets, home computers, work computers, mobile phones, is preserved and will
not be deleted;
• Contact any cloud-based data storage and/or email hosting platforms to ensure against
deletions, and verify a documented backup protocol is in place;
• Retain any hard copy documents, audio recordings, video recordings, videotape, e-mail
messages, texts, instant messages delivered on communication platforms (e.g., Teams,
Zoom chats), electronic documents (e.g., documents created using Microsoft Word,
Excel, Power Point, Access, OneNote), all social media postings including Facebook,
Instagram, LinkedIn, and Twitter, spreadsheets, databases, diaries, calendars, telephone
logs, contact manager information, Internet usage files, AWS logs, and all other
electronic information created, received, and/or maintained by you.

Don’ts:
• Do NOT delete any audio recordings, video recordings, videotape, e-mail messages,
texts, instant messages delivered on communication platforms (e.g., Teams, Zoom chats),
electronic documents (e.g., documents created using Microsoft Word, Excel, Power
Point, Access, OneNote), all social media postings including Facebook, Instagram,
LinkedIn and Twitter, spreadsheets, databases, diaries, calendars, telephone logs, contact
manager information, Internet usage files, and all other electronic information created,
received, and/or maintained by you.
