1 INTRODUCTION
1.1 Purpose

To ascertain the extent to which proposed works are likely to affect or be affected by existing
Utilities apparatus, including Statutory Undertakers for water, sewage, gas, electricity, and
telecommunications, as well as other utility providers including, but not limited to, pipeline
operators and other telecommunication providers.

The Statutory Undertakers Estimate will form part of the overall scheme cost estimate at each
stage of the projects’ lifecycle and is a statutory duty.

1.2 Executive Summary

The purpose of this document is to ascertain the extent to which Statutory Undertakers’
apparatus will be affected by the proposed schemes and associated costs likely to arise in
modifying or diverting such apparatus. This is a statutory duty under the New Roads and
Street Works Act 1991. Statutory estimates will form part of the overall scheme cost estimate
at each stage of the project lifecycle.

This Document had been initially prepared in Project Control Framework (PCF) Stage 3 and
consequentially updated where applicable in PCF stage 5 to reflect the current Statutory Undertakers
Information available.

2 PROJECT & PROGRAMME BACKGROUND


In October 2019, the Department for Transport (DfT) carried out an evidence stocktake of Smart
Motorway safety. Several recommendations were made following the findings of this stocktake. The
first recommendation in the report was to end the use of Dynamic Hard Shoulders (DHS) as it was
noted that this type of Smart Motorway had the potential to cause confusion for motorists. The DfT
committed to converting all existing DHS sections on the network into All Lane Running (ALR) by the
end of March 2025.

The Smart Motorway Programme (SMP) Alliance was later commissioned by National Highways
(NH) to deliver the DHS to ALR Upgrade Programme, including the M6 Junction (J)4-5 DHS to ALR
Upgrade scheme.

A Transport Select Committee (TSC) review in October 2021 recommended that NH should pause
plans to convert DHS motorways until the next Roads Investment Strategy (RIS) and use the
intervening period to trial alternative ways to operate DHS. The Government’s response to this
review on 12 January 2022 agreed with its recommendation to pause the conversion of DHS
motorways and committed to incorporating further safety measures and enhancements in line with
the Smart Motorways evidence stocktake and action plan.

NH subsequently instructed the SMP Alliance to support in developing a scope of safety related
works which could be adopted whilst maintaining the DHS operating regime on 28 January 2022.
This instruction allowed for the construction of an upgraded concrete safety barrier in the central
reserve and completion (but not construction) of the previous M62 J25-30 DHS to ALR Upgrade
design which was close to being completed. The scheme name was updated to be called M62 J25-
30 DHS Enhancements, forming part of the overall DHS Enhancements Programme.

The upgrade programme consists of seven DHS Enhancements schemes, these are shown in Figure 1
below.

The scope of the M62 J25-30 DHS Enhancements scheme is defined in the Scheme Order. It
consists of enhancing the M62 between J25 and 30 in accordance with the design standard GD301.
This order commissioned the SMP Alliance to take the scheme through PCF Stages 5, 6 and 7. The
construction works include, but are not limited to:

• New Places of Relative Safety (PRS)


• Replacing existing central reserve barrier with Rigid Concrete Barrier
• Verge side Vehicle Restraint System changes
• Installation of roadside technology including CCTV cameras
• Replacement of existing lighting in central reserve and verge
• New longitudinal ducting and cabling to support the new infrastructure

2.1 Appointment of Overseeing Organisation Agent (OOA)

The DHS Enhancements Programme is being delivered by the SMP Alliance. There therefore
is not one organisation acting as OOA.

3 C2 INQUIRIES
3.1 C2 Overview

The table below identifies the personnel with responsibility both within the scheme and National

3.2 C2 Correspondence

The attachment below identifies the companies contacted for each scheme and the date of
the C2 returns, with a brief summary of their outcome/any actions required. This has been
updated for each stage of the scheme so far, with the most recent requests being made in
March 2022.

3.3 C2 Commentary

In December 2020, during the preliminary design phase, Jacobs as part of the Alliance
undertook a C2 enquiry. As a result of this enquiry, and further follow up enquiries in
March/April 2022 for the DHS Enhancement works, a set of composite statutory undertakers’
equipment location plans have been produced in Stage 5.

These drawings are used in all stages of the design and will be at the appropriate time issued
to the Principal Contractor; it should be noted that these drawings do not absolve the Delivery
Partner of their responsibilities to contact the third parties directly.

The result of C2 preliminary inquiry is that, from those responses received, none have
identified potential diversion works. However. there are a number of utilities within reasonably
close proximity to proposed works which have been detailed in Table 2 below. However,
these are assumed to not be affected by the proposed works.

Location plans in the form of General Arrangement Drawings, have been provided for the
apparatus that has been identified in the vicinity of the scheme.

3.4 Next Steps

Any further responses to the C2 enquiry have been cross checked against the composite
statutory undertakers’ plans developed in PCF Stage 5 and updated where necessary.

The composite statutory undertakers’ plans are being assessed against the proposed design
throughout its development during the detailed design phase.

As part of the design development, should any alterations to the design occur, these are
being checked against the statutory undertakers’ information that has been received. Where
possible clashes with existing utilities occur, the first priority will be to amend the design to
avoid utilities. Where this is not possible then any potential clashes will be identified, and the
appropriate statutory undertaker contacted.

Prior to the commencement of works the Principal Contractor should request an updated C2
preliminary inquiry.

3.5 Risks

- Risk of striking services present on site whilst reconstructing the central reserve or new
proposed places of relative safety. Stats identified crossing the scheme extents outside of
existing structures have been identified in Table 2 below.

- If any locations of diversion routes fall outside of National Highways land, the risk around
there being a requirement for land to accommodate stats diversion and the time and cost
associated with this. However, no diversion requirements have been identified.

- Any potential diversions could take a significant amount of time from application to
completion, significant risk to programme if the SU diversions take longer than what is
currently anticipated. Some of the diversions may have seasonal or outage constraints which
is another consideration for the scheme programme. However, no diversion requirements
have been identified.

- No costs provided yet for any SU diversion work which could pose significant risk to the
projects budget. However, no diversion requirements have been identified.

- Small sections of physical construction works are ok with NH to install the PRS, but the
SU may need to go back to a node for their connections, this could be well outside of the NH
construction area.
