ADMINISTRATIVE DISCIPLINARY MACHINERY

Disciplinary Authority Jurisdiction

If the penalty is withholding of privileges;


restriction to specified limits; suspension
Chief of Police or forfeiture of salary; or any combination
thereof, for a period not exceeding
fifteen (15) days;

If the penalty is withholding of privileges;


Mayor restriction to specified limits; suspension
or forfeiture of salary; or any combination
thereof, for a period of not less than
sixteen (16) days but not exceeding
thirty (30)

If the penalty is withholding of privileges;


restriction to specified limits; suspension
People’s Law Enforcement Board or forfeiture of salary; or any combination
thereof, for a period exceeding thirty
(30) days; demotion or by dismissal
from the service.
Breach of Internal Discipline

Disciplinary Authority Jurisdiction

If the penalty is admonition;


reprimand; restriction to specified
Chief of Police or Equivalent Supervisor limits; withholding of privileges;
forfeiture of salary or suspension; or
any combination of the foregoing:
Provided, that in all cases, the total
period shall not exceed fifteen (15)
days;

If the penalty is admonition or


reprimand; restrictive custody;
Provincial Director or Equivalent withholding of privileges; forfeiture of
Supervisor salary or suspension; or any
combination of the foregoing:
Provided, that in all cases, the total
period shall not exceed thirty (30)
days.

If the penalty is dismissal from the


service; admonition or reprimand;
Regional Director or Equivalent restrictive custody; withholding of
Supervisor privileges; suspension or forfeiture of
salary; demotion; or any combination
of the foregoing: Provided, that in all
cases, the total period shall not
exceed sixty (60) days.

If the penalty is dismissal from the


service; demotion; suspension or
forfeiture of salary, or any
combination thereof for a period not
exceeding one hundred eighty (180)
Chief, PNP days.

Note: The Chief of the PNP has the


authority to place police personnel
under restrictive custody during the
pendency of a grave administrative or
criminal case against him.
Summary Dismissal

Disciplinary Authority Jurisdiction

1. When the charge is serious,


Regional Director and evidence of guilt is strong;
2. When the respondent is a
recidivist or has been
Chief, PNP repeatedly charged and there
are reasonable grounds to
believe that he is guilty of the
charge.
3. When the respondent is guilty
of a serious offense involving
National Police Commission conduct unbecoming of a
(NAPOLCOM) police officer; and
4. When any member or officer
has been absent without
official leave for a continuous
period of thirty (30) calendar
days or more.

Appellate jurisdiction

Mayors and the Chiefs of Police
in the exercise of their
disciplinary powers;

dismissal from the service;
