AND IN FAVOUR OF
The Mortgagor has already deposited on 08.01.2008 the following documents of title
in Schedule-I hereto relating to the property mentioned in Schedule-II with SIDBI with
the intent to create equitable mortgage by way of deposit of title deeds in favour of
SIDBI for the purpose of securing repayment to SIDBI of all the credit facilities
advanced and / or to be advanced to M/s. Vishal Label and Company, a sole
proprietary concern, carrying on business at No.18-A, Govindammal Layout, Asher
Nagar 3rd Street, Gandhi Nagar Post, Tirupur – 641603, hereinafter referred to as
the “borrower”, as per details given below.
WHEREAS towards security for the prompt repayment of the loan amount together
with the interest accrued thereon by the BORROWER, the MORTGAGOR has
already deposited with the LENDER at Tirupur Branch Office, title documents of the
schedule mentioned properties as per details given below sanctioned by the
Lender to the BORROWER with the intention to create mortgage in favour of the
LENDER;

Details of registration of charge with SRO on the above credit facilities are
given below:

WHEREAS the said MORTGAGOR do hereby declare that all the schedules
mentioned properties are, save and except the charges mentioned hereinabove, free
from all encumbrances and claims whatsoever and as such the said MORTGAGOR
is fully empowered and competent to deal with the schedule mentioned properties
and thus the equitable mortgage has now created by deposit of title deeds by way of
constructive delivery on 29.11.2022 by the said MORTGAGOR in favor of the said
LENDER to secure the due repayment and discharge of the said loan amount of
Rs.38.00 lakh (Rupees Thirty Eight Lakh Only) sanctioned by the LENDER
together with interest, further interest, penal interest, costs, charges, expenses and
all other monies payable under the Said Loan Agreement(s) / Letter(s) of Intent /
terms of sanction as amended from time to time by the SAID LENDER. Mortgage
created by the said MORTGAGOR are valid, subsisting and binding on them and by
those persons claiming through the said MORTGAGOR in respect of the scheduled
mentioned properties. Save and except the charges mentioned hereinabove, no
charge has been created over the properties.
WHEREAS the MORTGAGOR herein have guaranteed the prompt repayment of the
said loan amount together with the interest accrued thereon by the said
BORROWER;

All those piece and parcel of land admeasuring about 45 cents of dry land
situated within Coimbatore Registration District, Avinashi Sub Registration District,
Avinashi Taluk, Palangarai Village and Panchayat, bearing SF No.242
With the right to use the other mamool roads to reach the property
together with all building and structures thereon and plant and machinery attached to
earth or permanently fastened to anything attached to earth.
