SUBJECT: SMOKING BAN / SMOKING AREA

CIRCULAR NO. 2017-21

Good day valued tenants! This is with regards to the Executive Order 26 or the nationwide ban on smoking that
took effect starting last, July 23, 2017.

Under the E.O., smoking is prohibited in public and private transportation utilities, schools, and food
establishments. Waiting shed areas, streets and walkways are also covered by the ban. Individuals caught
violating the smoking ban will face fines ranging from ₱500 to ₱10,000 depending on the number of offenses.
Meanwhile owners of establishments caught violating it may be fined ₱5,000 or imprisoned for not more than
30 days.

As all the Local Government Units is taking the lead on monitoring compliance with the new policy. All local
governments are required to create a task force that will oversee the ban's implementation that is why yesterday
morning our Baranggay officials specifically Chairwoman Punongbayan called my attention regarding this matter
and prohibited the designated area we temporary issued as our “Smoking Area” located at the back of our building
(L.M. Guerrero St.) due to the following reasons aside from the fact that Smoking Area must be 100 meters away
from their Plaza & Baranggay Hall:

The following are the standards: (DSA- designated Smoking Area)


1. DSAs shall not have an opening that will allow air or cigarette smoke to escape to the smoke-free area of the
building except for a single door equipped with an automatic door closer;
2. DSAs shall not also be located in or within 10 meters from the entrances, exits or any place where people pass
or gather, or in front of air intake ducts;
3. DSAs shall have “Smoking Area” signage; graphic health warnings on the effects of tobacco use; and
prohibition on the entry of persons below 18 years old; and
4. The ventilation system of DSAs other than in an open area and for the buffer zone shall be independent of all
ventilation systems servicing the rest of the building.
Included in the EO are list of places where DSAs are not allowed like are youth-related facilities such as play
schools, preparatory schools, elementary schools, high schools, colleges and universities, youth hostels, and
recreational facilities for minors.
DSAs are not also allowed in elevators and staircases. They are off-limits in places where there are fire hazards
like gas stations and places with flammable liquids, gas, explosives or combustible materials.
Lastly, the EO stated that no DSAs should be established in premises of public hospitals, medical, dental and
optical clinics, health centers, nursing homes, dispensaries, laboratories and food preparation areas.

Therefore, our building must be declared a “Smoke-free” Building.


As the ban takes effect, we strongly advise our entire commercial tenant to put up signs that warn against
smoking.

Together, let us give our full cooperation and support to the smoke-free establishments in public and enclosed
places, to ensure quality service & to maintain our building standards, please follow accordingly. Thank you in
