Articles 1178: Subject to the laws, all rights acquired in virtue of an obligation are

transmissible if there has been no stipulation to the contrary

Transmissibility of rights exceptions:


1. Prohibited by law
- Rights in partnership, agency and commodatum
a. Contract of partnership
- Contribute money, property or industry to a common fund
b. Contract of agency
- Render some service or to do something in representation or behalf of
another
c. Contract of commodatum
- Delivers something not consumable so latter may use for a certain time

2. Prohibited by stipulation of parties


- Stipulation that upon the death of the creditor, obligation is extinguished, or that
creditor cannot assign his credit to another
