GUIDELINES AND PARTICIPATIonCONSENT FORM

I ___ [provide name] ___________as participant of the Hackathon event agree to the matters as follows.

1. Purpose

The purpose of this hackathon event is to generate innovation with participants contributing diverse
perspectives and knowledge together, creating ideas, providing their own technologies, and
implementing as actual products or process innovations.

2. Product or Systems Innovation

Copyrights (including rights prescribed in RA 8293 of the Philippines) patents, utility model rights, design
rights, trademark rights, other intellectual property rights (including rights to obtain such rights or rights
to apply for registration etc. of such rights; hereinafter referred to collectively as “Intellectual Property
Rights”) and any other rights relating to text, sketches, drawings, 3D data CG data, photos, audio, videos,
software, hardware prototypes and any other products (hereinafter referred to as “Products” that the
participant creates at this Event belong to the relevant participant who created such Products; provided,
however, that the participant who cannot be reached by reasonable methods after this Event shall be
deemed to have waived Intellectual Property Rights and any other rights relating to their Products.

3. Ideas

Ideas (including concepts, know-how etc.) provided by the participant during this Event, unless the
relevant participant who provided such ideas makes a claim and establishes rights as set forth in
Paragraph 4 below, will be available to FDC Misamis Corporation free of charge as common property.

Selected ideas will be supported to be developed further so that FDC Misamis Corporation will be able to
utilize these ideas; more efforts beyond the hackathon and finale are required from the selected teams
thereafter.

4. Disclosure

Organizers, persons who jointly host and provide support for the Event, guests and lecturers (hereinafter
referred to as “Organizers etc.”) may disclose Products by publishing them on websites, fliers, pamphlets,
and other advertisements and promotional materials for the purposes of promotion.
5. Compliance with rules, instructions, etc.

The participant shall follow rules, instructions and other regulations where the Event will be held and
other uses of the Platform (online, digital) provided by its Organizers.

6. Disclaimer

If a participant suffers damage to their life, body or property due to an accident during the Event, the
participant shall bear the responsibility and shall not claim any damage from the Organizer; provided,
however, that this damage did not result from the Organizer’s willful or gross negligence.

7. Prizes

The prize for the Grand Hackathon Winner may be considered as seed fund to support the commercial
viability or potential for enterprise/ livelihood. Individual token and certificates will be given to all
participants.

FDC Misamis and its organizers are not responsible for any dispute among teams or team participants
related to prizes.

8. Publicity and Privacy

Participant understands that the Hackathon Event may be photographed, videotaped, recorded, etc. and
hereby grants FDC Utilities Inc and FDC Misamis Corporation the right to use all photos and videos,
footage about Participant’s participation in the Hackathon Event in any manner. By participating in the
FDC Misamis Corporation Hackathon, Participants agree that their personal data provided as part of the
Hackathon may be used for the purpose of the FDC Misamis Hackathon.

*Personal information submitted by the participant will be treated in the accordance with RA 10173
known as the Data Privacy Act, and will not be used for other purposes except the Event of provided to
third parties without consent of the participant.
