ove r the radio station DYFX in cebu city on September 1994, and information for libel was filled before
the regional trial code CRTCLI of tagbilaran city agains petitioner torralba

Held: yes without the said authentication the tape recording is not incompetent and inadmissible in
evidence

Subject matter: this is second petition for habeas corpus by Boris Mejoff, the having been denied in a
decision of the court on july 30 ,1941

Fact: Boris Mejoff was an alien of Russian descent who was brought to Philippines from shanghai as a
secret operative by the Japanese force .he was arrested as a Japanese spy and handle to the
commonwealth government for disposition in accordance with common wealth Goverment for
disposition board found him illegally in the country and ordered him to deported on the first available
transportation to Russia in may 1948, he was transfer to Cebu provincial jail with three other Russians
to await the arrival of Russians vessels in October 1948 the auority remove him to bilibid prison at
Muntinlupa, where he was confined up to the present time the commissioner of immigration believes it
is for the best interests of the country to keep him under detention while arrangement for his departure
are being made.

Issue; whatever or not mejoff should be released from prison

Held: yes but subject to certain condition
