Joint Affidavit of Arrest

We, PMSg Jhon Paul Gumia , Pcpl Jonathan Gersin of legal age, a bonifide
member of the Philippine National Police and presently assigned at the Paranaque City
Police Station, located along Dr. A. Santos Avenue, Brgy Bf Homes, Paranaque City,
after having duly sworn to in accordance with law, do hereby depose and state:

1. That, on December 10, 2022, about 3:30 pm, we conducted follow up

operation regarding the robbery incident that transpired on December 10, 2022 about
6:00 am at No blk 1 lot 3 Silangan Masville Barangay Bf homes Paranaque City;

2. That, during the follow investigation and interview with the victim Jaiko
Jose Laga , the houseboy and identified the suspects as the Cjhay Hernandez;

3. That, on December 10, 2022 at about 9:00 am we conducted hot pursuit

operations wherein we proceed to the possible location of suspect Cjhay Hernandez at
Parañaque City, and we conducted casing and surveillance because he used volt
cutter for open padlock to enter in my house and was about to aquire my money and
jewels in my cabinet from my room. That, at about 1:00 AM on December 11, 2022, we
effected the arrest of Cjhay Hernandez and Kemp Estrella in his house located at 256
Silverio Compound Parañaque City. That I, PMsg Jhon Paul Gumia seized the firearms
Cal 9mm Taurus with serial number ABC387891 inserted with magazine loaded with 11
rounds ammunition and extra magazine loaded with 10 rounds ammunition and one
unit cellphone and cash amounting to Php 165,000.00 marked with EAD22 7-11-2021,
the aforementioned evidence was seen in plain view place on top of the table;

4. That, during our interview with Cjhay Hernandez, he stated that his
cohorts and two others who were not yet identified.

5. That, after the arrest of Kemp Estrella we immediately proceeded to the

location of Francisco Verona y Macam at Caloocan City. At about 7:15 AM on
December 11, 2021 we effected the arrest of Verona Francisco in his house located at
Taurus St. Pangarap Village Brgy 181 Caloocan City, we were recovered inside in his
house the two vaults and cash amounting to Php 270,000.00 marked with FMV 7-11-
2022, then the big vault marked as CZ3 7-11-2021, small vault marked as CZ2 7-11-
2022.

That I Pcpl Jonathan Gersin informed him the cause of his arrest, and his
Constitutional Rights under RA 7438 Right of the Arrested Person,

That we are executing this affidavit under oath to attest the truthfulness of the
foregoing facts and to support the filing of criminal charges against the aforementioned
suspects

6. That, with the proper coordination, we were able to view the CCTV
footages installed along Sucat Avenue, Masville and the CCTV camera’s installed at
the house of Jaiko Jose Laga located at No. blk 1 lot 3 Silangan Masville St., Brgy Bf
Homes, Paranaque City;

7. That, based on the CCTV footage, the suspects used a motorcycle with
plate number ABI 4578 and a RAIDER 150 color white.

8. That, in the course of our investigation, an informant revealed to us that

one of the suspects was former close-in security personnel of the complainant. Said
informant doesn’t want his name to be mentioned for his owned safety and his families.
However, said informant assured us that he personally know the close-in security
personnel and even told us that he will be willingly go with us for the arrest of the
suspect;

9. That, the informant disclosed to us the name of the close in security as

CJHAY HERNANDEZ and a resident of 256 Silverio Compound Parañaque City;

10. That, we immediately informed the Chief, IDMS of the result of our
investigation. Subsequently, on the same date, at around (lagay nyo time) am of
December 2022, we carefully set our course of action, to execute the arrest of Cjhay
Hernandez;

11. That, with all the information gathered at hand, guided by the informant
and using our vehicle we proceed to Silverio Compound, Parañaque City and
conducted the “HOT PURSUIT” operation;

12. That, at Brgy Silverio, Parañaque City, the informant told us that the place
of residence of Cjhay Hernandez is at 7th Street of Brgy Silverio, Parañaque City;

13. That, as soon as we reached the 7 th Street, Brgy Silverio, Parañaque city
City, the informant told us about the house of Cjhay Hernandez. As set out in our plan,
we (PMSg Gumia, Pcpl Gersin) immediately step out of the car with the informant, while
the other members of the team were inside the vehicle as back-ups;

14. That, the house is not well lighted. After an hour of surveillance, we
observed a male and a female person coming out of the target house, the duo was
identified by the informant as Cjhay Hernandez and his wife. The former was conversing
with his wife outside of their house when we approached them;

15. That, we (PMsg Gumia and Pcpl Gersin) immediately identified ourselves
as Police Officers assigned at Paranaque City Police Station by way of flashing to them
our respective PNP Identification Card;

16. That, (Pcpl Gersin) I observed something bulging on the waist of Cjhay
Hernandez and it resemble for a short firearm. Thus, to prevent any armed
confrontation, I immediately snatched the thing from the waist of Cjhay Hernandez and I
found out that it was a firearm, a 9mm caliber pistol, Taurus G39H19 model with serial
number ABC 123806, loaded with magazines, another magazine loaded with bullets
were recovered his possession and control.

17. That, I (PMsg Gumia) immediately informed Cjhay Hernandez of our

presence and the intention of apprehending him; and while doing so, the other members
of the team approached us;

18. That, we explain to him (Cjhay Hernandez) of the incident and the
evidence we have gathered at the crime scene. Upon the intercession of his wife, Cjhay
Hernandez broke down and become remorseful about the incident. He then
acknowledges the crime and avers that he was just given a small part of the loot by his
cohorts.

19. That, in the presence of his wife, Cjhay Hernandez returned the amount of
Php 165,000.00 and further reveals the identities of the other suspects and their
whereabouts;

20. That, I (PMSg Gumia) immediately informed Cjhay Hernandez of his right
under the law in the manner and language (Tagalog and English). Such us, his rights to
remain silent, anything he say will be used against him in the court of law, his right to
have a counsel of his owned choice and if he cannot afford the service of his own
counsel the government (court) will provide one for him, free of charge, and that his
right to know such rights. He was likewise informed of his right for a proper medical
examination and his rights against Torture.

21. That, according to Eymard Durwin, the other suspects were identified as
KEMP ESTRELLA of Taurus St. Pangarap Village Brgy 181 Caloocan City,

22. That, we executed this affidavit of arrest against the following person to
wit;

a. CJHAY HERNANDEZ y LOBO, 36 years old, male, married, jobless and a

resident of 256 7th St., Brgy Silverio, Parañaque City;
b. KEMP ESTRELLA y NAJAR, 36 years old, male, single, jobless and a resident
of Brgy Patag, Sta. Maria, Bulacan;
